THE NYC AMNESTY PROGRAM

Under the New York City Amnesty Program, which started September 12, 2016 and goes until December 12, 2016, the City is forgiving penalties and interest on violations received by individuals and businesses from the Department of Sanitation, Department of Buildings, and other City agencies. It’s important to note that parking violations ARE NOT included under the Amnesty Program.

The program will have a two-fold impact: It will help the City collect debt it is owed it will give New Yorkers a break on their violations in Judgment

Judgment: When the City has taken the legal step of filing a public record in court for the entire amount due.

THE NYC AMNESTY PROGRAM

Here’s how the program works: Any business or individual with violations in judgment before June 12,

2016, can participate in this program. Individuals and businesses that did not attend hearings and have

default penalties can have 100% of the penalties as well as interest forgiven.

Those who attended hearings and were found guilty only have to pay 75% of the base fine. They will also have interest forgiven.

THE NYC AMNESTY PROGRAM

The amnesty program covers two types of violations: those that require corrective action, known as compliance violations, and those that do not.

If you have a compliance violation, in addition to paying, you must prove that you have taken corrective action.

The Department of Buildings and the Fire Department issue most compliance violations. Individuals or businesses with compliance violations must pay a deposit of at least 25% of the amount due under the Amnesty Program, then they will have six months to correct the violation and pay their remaining balance.

After the 90-day amnesty period, individuals and businesses will have to pay penalties and interest on top of their base fines. The City will also resume and step up collection efforts, which include referring the judgments to the City Sheriff, and City Marshals, who are authorized to impose additional fees and seize assets, if necessary.

SPRINKLER SYSTEMS

A sprinkler system is a fire extinguishing system that utilizes water as the extinguishing agent

NYC Fire Code requires that all buildings that have a full or partial sprinkler system be maintained by a person who possesses the new S12 Certificate of Fitness

STANDPIPE SYSTEMS

A standpipe system is piping installed in a building that serves to transfer water to hose connections located within the building for firefighting purposes.

NYC Fire Code requires that all buildings that have a standpipe system be maintained by a person who possesses the new S13 or S14 Certificate of Fitness

FIRE ALARM SYSTEMS

A fire alarm system is any system arranged to monitor and annunciate the status of fire alarm or supervisory signal-initiating devices.

Examples of alarm devices would be manual pull stations, smoke detectors, duct smoke detectors, carbon monoxide detectors, and waterflow alarms

FIRE WATCH

Continuously patrol the affected area, keeping constant watch for fires.

Immediately report any fire to the department and notify emergency preparedness staff on the premises.

Trained in the use of portable fire extinguishers. Maintain a record of such fire watch on the premises during the

fire watch and for a minimum of 48 hours after the fire watch has concluded.

Have no other duties.

ASHRAE 188 AND LEGIONELLA

The governing federal guideline that is the basis for the New York State and New York City Legionella laws is ASHRAE 188 which was ratified and presented in June 2015. 

Subsequent to the deaths in New York city which were caused by Legionella the state and city first put out emergency orders from their respective Health Departments which were then converted into law.

IN NYC YOU ARE REQUIRED TO:

1. Register all cooling towers with the DOH- in NYC as well as NY State

2. Have a Water Management Plan (WMP) or Maintenance Program (MPP) on-site for each tower.

3. This document provides information regarding the system, its risk and hazards and actions to be taken to treat for the prevention of Legionella and the corrective action should legionella be found .

IN NYC YOU ARE REQUIRED TO:

4. Tower must be physically cleaned and disinfected at least 2x per year and first cleaning and disinfection is prior to the seasonal startup of the tower.

5. Tower must be visually inspected at least every 90 days while tower is in operation.

6. Legionella tests must be taken at the startup of the cooling tower and every 90 days while the tower is in operation.

7. The tower is to be tested 3x/week for pH, conductivity, free chlorine and temperature and recorded. This to be done by on-site responsible person as noted in the WMP/MPP.

8. A bacteria dipslide and a visual inspection is to be performed weekly by on-sire personnel and recorded. If results are not within guidelines of Chapter 8 of Title 24 DOH then corrective action must be taken and noted as per WMP/MPP.

PROGRAM TEAM – Identify persons responsible for Program development and implementation.

DESCRIBE WATER SYSTEMS/FLOW DIAGRAMS – Describe the potable and non potable water systems within the building and on the building site and develop water –system schematics.

ANALYSIS OF BUILDING WATER SYSTEMS – Evaluate where hazardous conditions may occur in the water systems and determine where control measures can be applied.

EPA RRP RULE Target housing is a home or residential unit built on or before December

31, 1977 except: Housing designated for the elderly or persons with disabilities (unless any

child who is less than 6 years of age resides or is expected to reside in such housing

Any zero-bedroom dwellings (studio apartments, hospitals, hotels, dormitories, etc.)

A Child-Occupied Facility is a pre-1978 building that meets all three of the criteria below (6-6-60 Rule);

Visited regularly by the same child, under 6 years of age The visits are on at least two different days within any week (Sun – Sat),

provided that each day’s visit lasts at least 3 hours Combined weekly visits last at least 6 hours, and the combined annual visits

at least 60 hours

Child-occupied facilities may be located in a public or commercial building or in target housing. These facilities include schools, child care and daycare centers

RENOVATION VS. ABATEMENT What is renovation?

Renovation, remodeling, and landscaping designed to repair, restore, or remodel a structure or dwelling, but NOT designed to permanently eliminate lead-based paint hazards (abatement) Even if these activities incidentally result in the reduction or elimination of lead-

If a violation with Order Number 616 (presumed lead-based paint violation) is issued, you also have the opportunity to contest the violation by having tests done of the painted surfaces in question

If a violation with Order Number 618 is issued, a lead-poisoned child has been identified in the building. In addition to the certification document, all ordered records and documents identified in the violation description must be submitted.

NEW MOLD REGULATIONSJANUARY 1ST, 2016

The Department’s new Mold Program, which is responsible for enforcing Article 32 of the New York State Labor Law, establishes licensing requirements and minimum work standards for professionals engaged in mold assessment and remediation

There are three main components to the new law:

COMPONENT 1: LICENSING

Contractors will not be allowed to advertise or perform covered work without the required license, with limited exceptions such as home or business owners performing work on their own properties. All licenses are certified by the New York State Department of Labor:

COMPONENT 2: TRAINING The Mold Program will protect consumers by

requiring contractors to obtain appropriate training prior to being licensed to perform mold assessment, remediation, or abatement services.

The courses and training providers are required to have approbal from the New York State Department of Labor:

COMPONENT 3: MINIMUM WORK STANDARDS The Mold Program also establishes new minimum work standards

for mold assessments and remediation activities by licensed professionals. The minimum standards are:

Protection against fraud by prohibiting the performance of both the assessment and remediation on the same property by the same individual;

Protection against fraud by requiring an independent mold assessment to define the scope of the remediation work;

Identification of disinfectant products, consistent with U.S. Environmental Protection Agency standards;

the mold and a recommendation as to the type of contractor who would remedy the source of such moisture

HOW YOU CAN COMPLY Posting of the remediation project is required, and

containment cannot be removed by any person until the mold remediation licensee overseeing the project has received a notice from a mold assessment licensee that the project has achieved clearance. This must be determined by post-remediation assessment

The post-remediation assessment shall determine that:

The work area is free from all visible mold; and All work has been completed in compliance with the

remediation plan and remediation work plan and meets clearance criteria specified in the plan.

FRIABLE AND NON-FRIABLE ACM Friable Materials:

Defined by the U.S. EPA NESHAP regulation, can be crumbled, pulverized, or crushed to powder by hand pressure when dry.

Able to release asbestos fibers with only minimum disturbance Non-friable Materials:

Products contain, in addition to asbestos, a bonding agent (for example, cement, plaster, asphalt, glue, etc.) which locks in asbestos fibers

Less likely to release asbestos fibers when disturbed Can become friable depending on how they are used, and what is

DOB NOW OVERVIEW In DOB NOW, building owners, design

professionals, filing representatives, and licensees can create online accounts, making it easier to submit applications, make payments, schedule appointments, check the status of an application, pull permits, and make renewals. 

DOB NOW will be released in phases throughout 2016 and 2017. In 2018, DOB NOW will be completed and will be the entry point for all DOB transactions.
