responderlosEstadosPartesobrelasaccionesrealizadasencumplimiento

IntroduccIón
La Convención Interamericana para Prevenir, Sancionar y Erradicar la Violencia contra la Mujer, “Convención de Belém Do Pará”, fue suscrita en el XXIV Período Ordinario de Sesiones de la Asamblea General de la Organización de los Estados Americanos en 1994, en Belém Do Pará, Brasil. México suscribió dicha convención en 1995 y fue hasta 1998 que se ratificó.
Esta Convención es uno de los principales instrumentos de derechos humanos de las mujeres dirigido a aplicar una acción concertada para prevenir, sancionar y eliminar la violencia contra las mujeres, basada en su género, al tiempo que condena todas las formas de violencia contra la mujer perpetradas en el hogar, en el mercado laboral o por el Estado y/o sus agentes.
Asimismo, la Convención de Belém Do Pará, define la violencia contra la mujer como “cualquier acción o conducta que cause muerte, daño o sufrimiento físico, sexual o psicológico a la mujer, tanto en el ámbito público como en el privado”.
El gobierno de México presentó en el año 2002, en el marco de la XXXI Asamblea de Delegadas de la Comisión Interamericana de Mujeres de la Organización de los Estados Americanos, una propuesta de mecanismo de seguimiento de la Convención de Belém Do Pará, considerando que no contaba con un mecanismo formal de este tipo, a la manera en que lo tienen las convenciones modernas. Como resultado de esta iniciativa mexicana, en octubre de 2004, los Estados Parte aprobaron por aclamación el Estatuto del Mecanismo de

Seguimiento de la Implementación de la citada Convención (MESECVI), el cual tiene carácter intergubernamental y está facultado para formular recomendaciones a los Estados Parte y dar seguimiento a la aplicación de las disposiciones de este instrumento a través de un sistema de cooperación técnica para el intercambio de información, experiencias y mejores prácticas entre los gobiernos del Hemisferio.
El MESECVI está integrado por una Conferencia de Estados Parte como órgano político y de un Comité de Personas Expertas con carácter técnico. El Mecanismo busca subsanar diferencias en el cumplimiento de la Convención, toda vez que, a pesar de los logros obtenidos mediante la adopción de política, programas y planes nacionales, no existe información suficiente ni registros que permitan evaluar la magnitud del problema de la violencia contra las mujeres, ni tampoco los resultados concretos obtenidos en cada uno de los Estados Parte.
Es así como esta Convención revela la interacción positiva entre los sistemas internacional y nacional de los derechos humanos y representa una fuerza positiva de cambio para avanzar en la protección y promoción de los derechos de las mujeres en nuestro país. Ejemplo de ello es la Ley General de Acceso de las Mujeres a una Vida Libre de Violencia, decretada en 2007, que no hubiera sido posible sin esa contribución – interacción proveniente de la esfera internacional.
La política exterior en materia de derechos humanos del Gobierno del Presidente Felipe Calderón tiene entre sus objetivos la apertura al escrutinio internacional y la plena cooperación con los órganos y mecanismos internacionales de derechos humanos; la implementación de estándares internacionales de derechos humanos a través de la armonización legislativa y del fortalecimiento institucional; y la participación constructiva en los foros internacionales en esta materia.

En ese contexto, para México el cumplimiento de las obligaciones internacionales representa un eje práctico para que los estándares de derechos humanos se interioricen de una manera efectiva, a niveles legislativo, institucional y de políticas públicas, tal es el caso de la Convención de Belém Do Pará.
Por ello, en el marco del apoyo de la Cámara de Diputados a la Cancillería para difundir y promover los tratados internacionales en materia de derechos humanos de las mujeres, resulta particularmente importante la publicación de la Convención Interamericana para Prevenir, Sancionar y Erradicar la Violencia contra las Mujeres o Convención de Belém do Pará y su Estatuto de Mecanismo de Seguimiento.
La promoción y protección de los derechos de las mujeres y la lucha contra toda forma de violencia en contra de las mujeres son prioridades fundamentales del Gobierno de México, es por esto que la Secretaría de Relaciones Exteriores se complace particularmente por la publicación de esta Convención.

Los Estados PartEs dE La PrEsEntE ConvEnCión:
Reconociendoqueelrespetoirrestrictoalosderechoshumanoshasido
consagrado en la Declaración Americana de los Derechos y Deberes
delHombreyen laDeclaraciónUniversalde losDerechosHumanosy
reafirmadoenotrosinstrumentosinternacionalesyregionales;
AfiRmAndoquelaviolenciacontralamujerconstituyeunaviolación
de los derechos humanos y las libertades fundamentales y limita total
o parcialmente a la mujer el reconocimiento, goce y ejercicio de tales
derechosylibertades;
PReocuPAdos porque laviolenciacontra lamujeresunaofensa
a la dignidad humana y una manifestación de las relaciones de poder
históricamentedesigualesentremujeresyhombres;
RecoRdAndolaDeclaraciónsobrelaErradicacióndelaViolencia
contra la Mujer, adoptada por la Vigésima Quinta Asamblea de
Delegadasde laComisión InteramericanadeMujeres,yafirmandoque
laviolenciacontralamujertrasciendetodoslossectoresdelasociedad
independientementedesuclase,razaogrupoétnico,niveldeingresos,
cultura, nivel educacional, edad o religión y afecta negativamente sus
propiasbases;
convencidosdequelaeliminacióndelaviolenciacontralamujer
escondiciónindispensableparasudesarrolloindividualysocialysuplena
eigualitariaparticipaciónentodaslasesferasdevida;y

convencidosdequelaadopcióndeunaconvenciónparaprevenir,
sancionar y erradicar toda forma de violencia contra la mujer, en el
ámbito de la Organización de los Estados Americanos, constituye una
positivacontribuciónparaprotegerlosderechosdelamujeryeliminarlas
situacionesdeviolenciaquepuedanafectarlas,
HAnconvenidoenlosiguiente:

Artículo 1. Para los efectos de esta Convención debe entenderse por
violencia contra la mujer cualquier acción o conducta, basada en su
género,quecausemuerte,dañoosufrimientofísico,sexualopsicológico
alamujer,tantoenelámbitopúblicocomoenelprivado.
Artículo 2. Seentenderáqueviolenciacontralamujerincluyelaviolencia
física,sexualypsicológica:
a)quetengalugardentrodelafamiliaounidaddomésticaoencualquier
otrarelacióninterpersonal,yaseaqueelagresorcompartaohaya
compartidoelmismodomicilioquelamujer,yquecomprende,entre
otros,violación,maltratoyabusosexual;
b)que tenga lugar en la comunidad y sea perpetrada por cualquier
persona y que comprende, entre otros, violación, abuso sexual,
tortura,tratadepersonas,prostituciónforzada,secuestroyacoso
sexualenellugardetrabajo,asícomoeninstitucioneseducativas,
establecimientosdesaludocualquierotrolugar,y
c)que sea perpetrada o tolerada por el Estado o sus agentes,
dondequieraqueocurra.

Artículo 3.Todamujertienederechoaunavidalibredeviolencia,tanto
enelámbitopúblicocomoenelprivado.
Artículo 4. Todamujertienederechoalreconocimiento,goce,ejercicioy
proteccióndetodoslosderechoshumanosyalaslibertadesconsagradas
porlosinstrumentosregionaleseinternacionalessobrederechoshumanos.
Estosderechoscomprenden,entreotros:
a)elderechoaqueserespetesuvida;
b)elderechoaqueserespetesuintegridadfísica,psíquicaymoral;
c)elderechoalalibertadyalaseguridadpersonales;
d)elderechoanosersometidaatorturas;
e)elderechoaqueserespeteladignidadinherenteasupersonay
queseprotejaasufamilia;
f)elderechoaigualdaddeprotecciónantelaleyydelaley;
g)el derecho a un recurso sencillo y rápido ante los tribunales
competentes,quelaamparecontraactosqueviolensusderechos;
h)elderechoalibertaddeasociación;
i)elderechoalalibertaddeprofesarlareligiónylascreenciaspropias
dentrodelaley;y
j)elderechoatenerigualdaddeaccesoalasfuncionespúblicasde
supaísyaparticiparenlosasuntospúblicos,incluyendolatomade
decisiones.
Artículo 5. Toda mujer podrá ejercer libre y plenamente sus derechos
civiles,políticos,económicos,socialesyculturalesycontaráconlatotal
proteccióndeesosderechosconsagradosenlosinstrumentosregionales
ConvenCión interameriCana para prevenir, SanCionar y erradiCar la violenCia Contra la mujer
o ConvenCión de Belém do pará y Su eStatuto de meCaniSmo de Seguimiento 15

e internacionales sobre derechos humanos. Los Estados Partes
reconocenquelaviolenciacontralamujerimpideyanulaelejerciciode
esosderechos.
Artículo 6.Elderechodetodamujeraunavidalibredeviolenciaincluye,
entreotros:
a)elderechodelamujeraserlibredetodaformadediscriminación,y
b)elderechodelamujeraservaloradayeducadalibredepatrones
estereotipadosdecomportamientoyprácticassocialesyculturales
basadasenconceptosdeinferioridadosubordinación.

Artículo 7.LosEstadosPartescondenantodaslasformasdeviolencia
contralamujeryconvienenenadoptar,portodoslosmediosapropiadosy
sindilaciones,políticasorientadasaprevenir,sancionaryerradicardicha
violenciayenllevaracabolosiguiente:
a)abstenerse de cualquier acción o práctica de violencia contra la
mujer y velar porque lasautoridades, sus funcionarios, personal
y agentes e instituciones se comporten de conformidad con esta
obligación;
b)actuarconladebidadiligenciaparaprevenir,investigarysancionar
laviolenciacontralamujer;
c)incluir en su legislación interna normas penales, civiles y
administrativas,asícomolasdeotranaturalezaqueseannecesarias
paraprevenir,sancionaryerradicar laviolenciacontra lamujery
adoptarlasmedidasadministrativasapropiadasqueseandelcaso;

d)adoptarmedidas jurídicasparaconminaralagresoraabstenerse
dehostigar, intimidar,amenazar,dañaroponerenpeligro lavida
de lamujerdecualquier formaqueatentecontrasu integridado
perjudiquesupropiedad;
e)tomar todas lasmedidasapropiadas, incluyendomedidasde tipo
legislativo,paramodificaroabolir leyesyreglamentosvigentes,o
paramodificarprácticasjurídicasoconsuetudinariasquerespalden
lapersistenciaolatoleranciadelaviolenciacontralamujer;
f)establecerprocedimientos legales justosyeficacespara lamujer
que haya sido sometida a violencia, que incluyan, entre otros,
medidas de protección, un juicio oportuno y el acceso efectivo a
talesprocedimientos;
g)establecer losmecanismosjudicialesyadministrativosnecesarios
para asegurar que la mujer objeto de violencia tenga acceso
efectivo a resarcimiento, reparación del daño u otros medios de
compensaciónjustosyeficaces,y
h)adoptar las disposiciones legislativas o de otra índole que sean
necesariasparahacerefectivaestaConvención.
Artículo 8. LosEstadosPartesconvienenenadoptar,enformaprogresiva,
medidasespecíficas,inclusiveprogramaspara:
a)fomentarelconocimientoylaobservanciadelderechodelamujer
a una vida libre de violencia, y el derecho de la mujer a que se
respetenyprotejansusderechoshumanos;
b)modificar lospatrones socioculturales de conductadehombres y
mujeres,incluyendoeldiseñodeprogramasdeeducaciónformales
ynoformalesapropiadosatodoniveldelprocesoeducativo,para
contrarrestarprejuiciosycostumbresytodootrotipodeprácticas,
que se basen en la premisa de la inferioridad o superioridad de
ConvenCión interameriCana para prevenir, SanCionar y erradiCar la violenCia Contra la mujer
o ConvenCión de Belém do pará y Su eStatuto de meCaniSmo de Seguimiento 17

cualquieradelosgénerosoenlospapelesestereotipadosparael
hombreylamujerquelegitimizanoexacerbanlaviolenciacontrala
mujer;
c)fomentar la educación y capacitación del personal en la
administracióndejusticia,policialydemásfuncionariosencargados
delaaplicacióndelaley,asícomodelpersonalacuyocargoestéla
aplicacióndelaspolíticasdeprevención,sanciónyeliminaciónde
laviolenciacontralamujer;
d)suministrarlosserviciosespecializadosapropiadosparalaatención
necesariaa lamujerobjetodeviolencia,pormediodeentidades
de los sectores público y privado, inclusive refugios, servicios de
orientaciónparatodalafamilia,cuandoseadelcaso,ycuidadoy
custodiadelosmenoresafectados;
e)fomentar y apoyar programas de educación gubernamentales y
del sector privado destinados a concientizar al público sobre los
problemasrelacionadosconlaviolenciacontralamujer,losrecursos
regalesylareparaciónquecorresponda;
f)ofreceralamujerobjetodeviolenciaaccesoaprogramaseficacesde
rehabilitaciónycapacitaciónquelepermitanparticiparplenamente
enlavidapública,privadaysocial;
g)alentar a los medios de comunicación a elaborar directrices
adecuadasdedifusiónquecontribuyanaerradicarlaviolenciacontra
lamujerentodassusformasyarealzarelrespetoaladignidadde
lamujer;
h)garantizar la investigacióny recopilacióndeestadísticasydemás
informaciónpertinentesobrelascausas,consecuenciasyfrecuencia
delaviolenciacontralamujer,conelfindeevaluarlaeficaciade
lasmedidasparaprevenir,sancionaryeliminarlaviolenciacontra
lamujerydeformularyaplicarloscambiosqueseannecesarios;y

i)promoverlacooperacióninternacionalparaelintercambiodeideas
yexperienciasylaejecucióndeprogramasencaminadosaproteger
alamujerobjetodeviolencia.
Artículo 9. ParalaadopcióndelasmedidasaqueserefiereesteCapítulo,
los Estados Partes tendrán especialmente en cuenta la situación de
vulnerabilidadalaviolenciaquepuedasufrirlamujerenrazón,entreotras,
desurazaodesucondiciónétnica,demigrante,refugiadaodesplazada.
En igual sentido se considerará a la mujer que es objeto de violencia
cuandoestáembarazada,esdiscapacitada,menordeedad,anciana,o
estáensituaciónsocioeconómicadesfavorableoafectadaporsituaciones
deconflictosarmadosodeprivacióndesulibertad.
CaPítuLo ivmECanismos intEramEriCanos dE ProtECCión
Artículo 10. Con el propósito de proteger el derecho de la mujer a
una vida libre de violencia, en los informes nacionales a la Comisión
InteramericanadeMujeres,losEstadosPartesdeberánincluirinformación
sobrelasmedidasadoptadasparapreveniryerradicarlaviolenciacontra
lamujer,paraasistiralamujerafectadaporlaviolencia,asícomosobre
lasdificultadesqueobservenenlaaplicacióndelasmismasylosfactores
quecontribuyanalaviolenciacontralamujer.
Artículo 11. Los Estados Partes en esta Convención y la Comisión
Interamericana de Mujeres, podrán requerir a la Corte Interamericana
deDerechosHumanosopiniónconsultivasobrelainterpretacióndeesta
Convención.

Artículo 12. Cualquier persona o grupo de personas, o entidad no
gubernamental legalmentereconocidaenunoomásEstadosmiembros
de la Organización, puede presentar a la Comisión Interamericana de
Derechos Humanos peticiones que contengan denuncias o quejas de
violacióndelartículo7de lapresenteConvenciónporunEstadoParte,
ylaComisiónlasconsiderarádeacuerdoconlasnormasylosrequisitos
de procedimiento para la presentación y consideración de peticiones
estipuladosenlaConvenciónAmericanasobreDerechosHumanosyen
elEstatutoyelReglamentodelaComisiónInteramericanadeDerechos
Humanos.

Artículo 13.NadadelodispuestoenlapresenteConvenciónpodráser
interpretadocomo restriccióno limitacióna la legislación internade los
EstadosPartesqueprevea igualesomayoresproteccionesygarantías
delosderechosdelamujerysalvaguardiasadecuadasparapreveniry
erradicarlaviolenciacontralamujer.
Artículo 14.NadadelodispuestoenlapresenteConvenciónpodráser
interpretado como restricción o limitación a la Convención Americana
sobreDerechosHumanosoaotrasconvencionesinternacionalessobre
lamateriaquepreveanigualesomayoresproteccionesrelacionadascon
estetema.
Artículo 15.LapresenteConvenciónestáabiertaalafirmadetodoslos
EstadosmiembrosdelaOrganizacióndelosEstadosAmericanos.

Artículo 16. La presente Convención está sujeta a ratificación. Los
instrumentosderatificaciónsedepositaránenlaSecretaríaGeneraldela
OrganizacióndelosEstadosAmericanos.
Artículo 17. La presente Convención queda abierta a la adhesión de
cualquierotroEstado.Losinstrumentosdeadhesiónsedepositaránenla
SecretaríaGeneraldelaOrganizacióndelosEstadosAmericanos.
Artículo 18. Los Estados podrán formular reservas a la presente
Convenciónalmomentodeaprobarla,firmarla,ratificarlaoadheriraella,
siempreque:
a)noseanincompatiblesconelobjetoypropósitodelaConvención;
b)noseandecaráctergeneralyversensobreunaomásdisposiciones
específicas.
Artículo 19. Cualquier Estado Parte puede someter a la Asamblea
General, por conducto de la Comisión Interamericana de Mujeres, una
propuestadeenmiendaaestaConvención.
LasenmiendasentraránenvigorparalosEstadosratificantesde
lasmismasenlafechaenquedosterciosdelosEstadosParteshayan
depositadoelrespectivoinstrumentoderatificación.Encuantoalrestode
losEstadosPartes,entraránenvigoren la fechaenquedepositensus
respectivosinstrumentosderatificación.
Artículo 20. LosEstadosPartesquetengandosomásunidadesterritoriales
enlasquerijandistintossistemasjurídicosrelacionadosconcuestiones
tratadasenlapresenteConvenciónpodrándeclarar,enelmomentodela
firmaratificaciónoadhesión,quelaConvenciónseaplicaráatodassus
unidadesterritorialesosolamenteaunaomásdeellas.

Talesdeclaracionespodránsermodificadasencualquiermomento
mediantedeclaracionesulteriores,queespecificaránexpresamente lao
lasunidades territorialesa lasqueseaplicará lapresenteConvención.
DichasdeclaracionesulterioressetransmitiránalaSecretaríaGeneralde
laOrganizacióndelosEstadosAmericanosysurtiránefectotreintadías
despuésderecibidas.
Artículo 21.LapresenteConvenciónentraráenvigoreltrigésimodíaa
partirdelafechaenquesehayadepositadoelsegundoinstrumentode
ratificación. Para cada Estado que ratifique o adhiera a la Convención
despuésdehabersidodepositadoelsegundoinstrumentoderatificación,
entraráenvigoreltrigésimodíaapartirdelafechaenquetalEstadohaya
depositadosuinstrumentoderatificaciónoadhesión.
Artículo 22. ElSecretarioGeneralinformaráatodoslosEstadosmiembros
delaOrganizacióndelosEstadosAmericanosdelaentradaenvigorde
laConvención.
Artículo 23. El Secretario General de la Organización de los Estados
Americanospresentaráun informeanuala losEstadosmiembrosde la
Organización sobre el estado de esta Convención, inclusive sobre las
firmas,depósitosdeinstrumentosderatificación,adhesiónodeclaraciones,
asícomolasreservasquehubierenpresentadolosEstadosPartesy,en
sucaso,elinformesobrelasmismas.
Artículo 24. La presente Convención regirá indefinidamente, pero
cualquieradelosEstadosPartespodrádenunciarlamedianteeldepósitode
uninstrumentoconesefinenlaSecretaríaGeneraldelaOrganizaciónde
losEstadosAmericanos.Unañodespuésapartirdelafechadeldepósito

delinstrumentodedenuncia,laConvencióncesaráensusefectospara
el Estado denunciante, quedando subsistente para los demás Estados
Partes.
Artículo 25. El instrumento original de la presente Convención, cuyos
textosenespañol,francés,inglésyportuguéssonigualmenteauténticos,
serádepositadoenlaSecretaríaGeneraldelaOrganizacióndelosEstados
Americanos,laqueenviarácopiacertificadadesutextoparasuregistroy
publicaciónalaSecretaríadelasNacionesUnidas,deconformidadconel
artículo102delaCartadelasNacionesUnidas.
ENFEDELOCUAL,losplenipotenciariosinfrascritos,debidamente
autorizadosporsusrespectivosgobiernos,firmanelpresenteConvenio,
que se llamará Convención Interamericana para Prevenir, Sancionar y
ErradicarlaViolenciacontralaMujer“ConvencióndeBelémdoPará”.

PreámBulo
Teniendo en cuenta que la Convención Interamericana para Prevenir,
SancionaryErradicarlaViolenciacontralaMujer,“ConvencióndeBelém
do Pará”, tiene el propósito de proteger los derechos humanos de las
mujeres y eliminar las situaciones de violencia que puedan afectarlas,
yaque todamujer tienederechoaunavida libredeviolencia, tantoen
el ámbito público como en el privado, y que es necesario fortalecer la
cooperaciónentrelosEstadosParteeneldesarrollodelosmecanismos,
políticas, programas y planes necesarios para prevenir, sancionar y
erradicarlaviolenciacontralasmujeres;
Reconociendo, que hasta la fecha se han alcanzado logros
importantesenlaimplementacióndelasdisposicionesdela“Convenciónde
BelémdoPará”,tantoenelámbitointernacionalcomonacional,medianteel
avancedelordenamientojurídicointernodelosEstadosParteyeldesarrollo
de políticas, programas y planes implementados por los Mecanismos
NacionalesdelaMujeryotrasinstitucionesyorganismosdelEstado;
Destacando, que la existencia de un mecanismo que permita
dar seguimiento y analizar la forma en que la Convención está siendo
implementadayquefacilitelacooperaciónentrelosEstadosParteentre
sí y el conjunto de los Estados Miembros de la OEA contribuirá a la
consecucióndelospropósitosdelamisma;

La Conferencia de los Estados Parte conviene en el siguiente
MecanismodeSeguimientodelaimplementacióndela“Convenciónde
BelémdoPará”:
Artículo 1. Propósitos / objetivos
1.1 LospropósitosdelMecanismoserán:
a.Dar seguimiento a los compromisos asumidos por los Estados
Parte de la Convención y analizar la forma en que están siendo
implementados;
b.PromoverlaimplementacióndelaConvenciónycontribuirallogro
delospropósitosestablecidosenella;
c.Establecer un sistema de cooperación técnica entre los Estados
Parte, el cual estará abierto a otros Estados Miembros y
observadores permanentes, para el intercambio de información,
experiencias y mejores prácticas como medio de actualizar y
armonizar sus legislaciones internas, cuando corresponda, y
alcanzarotrosobjetivoscomunesvinculadosalaConvención.
Artículo 2. Principios fundamentales
2.1 ElMecanismodeSeguimientodeloscompromisosasumidosporlos
EstadosParteenlaConvenciónsedesarrollaráenelmarcodelos
propósitosyprincipiosestablecidosenlaCartadelaOrganización
de los Estados Americanos. En tal sentido, las atribuciones de
este Mecanismo y los procedimientos que emplee deberán tener
en cuenta los principios de soberanía, de no-intervención y de
igualdadjurídicadelosEstados,asícomolanecesidadderespetar

la Constitución y los principios fundamentales del ordenamiento
jurídicodecadaEstadoParte.
Artículo 3. Características
3.1 El Mecanismo de Seguimiento de la implementación de la
Convenciónesdecarácterintergubernamentalytienelassiguientes
características:
a.Seráimparcialyobjetivoensuoperaciónyenlasconclusionesy
recomendacionesqueemita.
b.Garantizaráunaaplicación justayun tratamiento igualitarioentre
losEstadosParte.
c.Podrá formular recomendaciones a los Estados Parte y dar
seguimientoalcumplimientodelasmismas.
d.Seráunejerciciodesarrolladosobreunabaseconsensualysobrela
basedelprincipiodecooperaciónentrelosEstadosParte.
e.Estableceráunadecuadoequilibrioentre laconfidencialidaddela
evaluaciónylatransparenciadelproceso.
Artículo 4. Miembros
4.1 TodoslosEstadosPartedelaConvenciónseránmiembros,estarán
representadosyparticiparánenelMecanismodeSeguimiento.Los
EstadosMiembrosdelaOEAquenoseanpartedelaConvención,y
queasílosoliciten,podránparticiparencalidaddeobservadores.
Artículo 5. Estructura
5.1 El Mecanismo de Seguimiento constará de dos órganos: la
ConferenciadelosEstadosParteenadelante“laConferencia”yel
ComitédeExpertas/osenadelante“elComité”.
5.2 La Conferencia es el órgano político del Mecanismo, estará
integrada por representantes de todos los Estados Parte de la
ConvenCión interameriCana para prevenir, SanCionar y erradiCar la violenCia Contra la mujer
o ConvenCión de Belém do pará y Su eStatuto de meCaniSmo de Seguimiento 29

Convenciónysereunirádemaneraordinariacadadosañosyde
maneraextraordinariacuantasvecesloconsiderenecesario.
5.3 ElComitéeselórganotécnicodelMecanismoyestaráintegrado
porexpertas/osenlaesferaabarcadaporlaConvención,quienes
ejercerán sus funciones a título personal. Serán designadas/os
por cada uno de los Estados Parte de la Convención, entre sus
nacionales. El Comité se reunirá en función de su propio plan y
metodologíadetrabajo.
5.4 La Secretaría de la Conferencia y del Comité será la Secretaría
General de la OEA a través de la Secretaría Permanente de la
CIMyconelasesoramiento,cuandocorresponda,delaComisión
InteramericanadeDerechosHumanos(CIDH).
Artículo 6. Responsabilidades
6.1 LasresponsabilidadesdelaConferenciason:
a.FormulardirectricesgeneralesparaeltrabajodelComitéyactuar
comosuórganoconsultor.
b.Recibir,analizaryevaluarlosinformesdelComité.
c.Publicarydifundir,encoordinaciónconlaSecretaríaGeneraldela
OEA,elinformefinaldelMecanismo.
d.Resolver cualquier asunto relacionado con el funcionamiento del
Mecanismo.
6.2 LasresponsabilidadesdelComitéson:
a.Formularsupropioreglamento.
b.Elaborarlametodologíaydefiniruncronogramadetrabajo.
c.Recibir y evaluar los informes de los Estados Parte y emitir sus
recomendaciones.
d.PresentarsusinformesalaConferencia.

Artículo 7. Sede
7.1 ElMecanismodeSeguimientotendrásusedeenlaOrganizaciónde
losEstadosAmericanos,enlaSecretaríaPermanentedelaCIM.
Artículo 8. Funcionamiento
8.1 Seleccióndedisposicionesymetodología:
a.LaSecretaríadelComitésometeráaconsideracióndelComitéun
documentoenelqueseleccionarálasdisposicionesincluidasenla
ConvencióncuyaaplicaciónporlosEstadosPartepodráserobjeto
de análisis y decidirá, de acuerdo con los recursos financieros
disponibles,cuálserá laduracióndeunperíododesesionesque
dedicará a ese trabajo, el cual se denominará ronda, y cuántos
informesseránconsideradosencadasesión.
b.Encadaronda,laSecretaríadelComitéprepararáuncuestionario
sobrelasdisposicionesquesehayanseleccionado.Elcuestionario,
unavezaprobadoporelComitédeExpertas/os,seráremitidoalos
EstadosParte,quienessecomprometenadarlerespuestadentro
delplazofijadoporelpropioComité.Lasrespuestasalcuestionario
debensercirculadasentretodoslosintegrantesdelComité.
c.Al principio de cada ronda, el Comité analizará la información
correspondiente a cada Estado Parte y fijará un calendario para
llevaracabodichoanálisismedianteelusodeunmedioimparcial,
previamentedeterminadocomoson,elordenalfabético,elsorteoo
elordencronológicoderatificacióndelaConvención.LaSecretaría
delComitéharápúblicaestainformación.
d.Afindedesarrollarsuslabores,elComitédeterminarálametodología
apropiadaparacumplirconsuplandetrabajo.
8.2 Informefinal:
a.Al terminar la revisión de los informes de todos los Estados
Parte en cada ronda, el Comité emitirá un informe final con las
ConvenCión interameriCana para prevenir, SanCionar y erradiCar la violenCia Contra la mujer
o ConvenCión de Belém do pará y Su eStatuto de meCaniSmo de Seguimiento 31

recomendacionescorrespondientes,queincluyalasobservaciones
decadaEstadoPartequehayasidoanalizado,elcualseráremitido
a la Conferencia y, una vez hecho público, a la Asamblea de
DelegadasdelaCIM.
8.3. Seguimientoderecomendaciones:
a.El Comité establecerá las modalidades necesarias para dar
seguimiento al cumplimiento de las recomendaciones que se
formulenenelinformefinaldecadaEstadoParte.
Artículo 9. Tratamiento igualitario
9.1 Paraasegurar la eficiencia delMecanismo y lograr queeste sea
una evaluación entre iguales, cuyo objeto es el de fortalecer la
comunicación y el intercambio de experiencias entre los Estados
Partes,elComitédeExpertas/osdeberátenerencuentaque:
a.TodoslosEstadosPartesseránanalizadosenelmarcodelaronda,
ydeacuerdoconlosmismoscriteriosyprocedimientos.
b.LoscuestionariosseránigualesparatodoslosEstadosPartes.
c.Todos los informesde losEstadosPartedeberán tener lamisma
estructura.
Artículo 10. Cooperación intergubernamental y participación de la
sociedad civil
10.1 LaConferenciadeEstadosParteyelComitédeExpertas/osdel
Mecanismo de Seguimiento de la Convención tienen carácter
intergubernamental. La Conferencia y el Comité de Expertas/os
tendránlafacultaddeinvitarensussesionesplenariasalosEstados
quenosonEstadosPartedelaConvención.
10.2 ElComité,afindeobtenermayoreselementosdeanálisis,incluirá
en su reglamento disposiciones que garanticen la participación

de las organizaciones de la sociedad civil, en particular aquellas
relacionadasconelobjetode la"ConvencióndeBelémdoPará",
deconformidadconlosprincipioscontenidosenlasDirectricespara
laParticipacióndelasOrganizacionesdelaSociedadCivilenlas
ActividadesdelaOEA(CP/RES.759(1217/99))yladefiniciónde
sociedadcivilcontenidaenlaResoluciónAG/RES1661(XXIX-O/99).
10.3 ConsiderandolospropósitosdelMecanismodeSeguimientoyenel
marcodelProgramasobreDerechosHumanosdelaMujer,Equidad
eIgualdaddeGénero,elComitécooperarácontodoslosEstados
Miembrosde laOEAqueasí lo soliciten, teniendoen cuenta las
actividadesencursoenlaOrganización,einformaráalrespectoa
laConferencia.
10.4 Los Estados Parte establecerán mecanismos que faciliten la
cooperaciónyasistenciatécnicaparaelintercambiodeinformación,
experienciasymejoresprácticas,quepermitandarcumplimientoa
laConvención.
Artículo 11. Recursos
11.1 LasactividadesdelMecanismodeSeguimientoseránfinanciadas
por un fondo específico creado con este propósito, mediante
contribuciones de los Estados Parte de la Convención, los
Estados Miembros que no son Parte en la Convención, los
Estados observadores permanentes, los organismos financieros
internacionales, otros recursos externos y toda otra contribución
que pueda recibirse de acuerdo con las Normas Generales para
el Funcionamiento de la Secretaría General de la Organización
de los Estados Americanos. Dichas contribuciones podrán incluir
ofrecimientosdelosEstadosParteparaorganizarysersededelas
reunionesdelosórganosdelMecanismo.

11.2 LaConferenciadelosEstadosPartepodrádeterminarcriteriospara
determinarcontribucionesregulares.
Artículo 12. Revisión periódica del Mecanismo
12.1 La Conferencia examinará periódicamente el funcionamiento del
Mecanismo, teniendo en cuenta las observaciones del Comité
de Expertas/os, y podrá introducir las modificaciones que estime
convenientes.
Artículo 13. Informe a la Asamblea General de la OEA
13.1 La Conferencia, en colaboración con la Secretaría del Comité,
informarácadadosañosalaAsambleaGeneraldelaOEAsobre
lostrabajosrealizadosduranteeseperíodo,relativoalosavances
ydesafíosymejoresprácticasqueemanendelosinformesfinales
queelaboren,yensucaso,formularárecomendacionesgenerales
siloestimaraprocedente.
Artículo 14. Disposición transitoria
14.1 ElpresenteEstatutoentraráenvigorenlafechadesuadopciónpara
aquellosEstadosquehandepositadoelinstrumentoderatificación
de la Convención Interamericana para Prevenir, Sancionar y
Erradicar la Violencia contra la Mujer, "Convención de Belém do
Pará".

Artículo 1. Alcance del Reglamento.
El presente Reglamento regirá la organización y el funcionamiento
del Comité de Expertas/os del Mecanismo de Seguimiento de la
ImplementacióndelaConvenciónInteramericanaparaPrevenir,Sancionar
yErradicarlaViolenciacontralaMujer,“ConvencióndeBelémdoPará”
(MESECVI),enadelante,respectivamente,elComité,ylaConvención.
ElComité,elórganotécnicodelMecanismo,cumplirásusfunciones
enelmarcode lospropósitos,principios fundamentales,características
y demás disposiciones establecidas en el Estatuto del MESECVI, en
adelanteelEstatuto,delasdecisionesqueadoptelaConferenciadelos
EstadosParte,enadelantelaConferencia,y,enlopertinente,delaCarta
delaOrganizacióndelosEstadosAmericanos(OEA).
LoscasosnoprevistosenesteReglamentoyquenoloesténen
elEstatutonienlaCartadelaOEA,podránserresueltosporelComitéen
consultaconlaConferencia.
ii. organizaCión y funCionamiEnto dEL Comité dE ExPErtas/os
Artículo 2. Composición del Comité.
El Comité estará integrado por expertas/os en la esfera abarcada por
la Convención, que serán designadas/os por cada uno de los Estados
Partede lamismayejerceránsusfuncionesdemanera independiente,
autónoma y a título personal. Las/os expertas/os no participarán en la
evaluacióndesupropiopaís.
Las/osexpertas/ostitularesysuplentesdelComitédeberántener
conocimientos técnicos sólidos y experiencia en los diferentes temas
abarcadosporlaConvención.

Las/osexperta/osejerceránsusfuncionesporlomenosdurante
unperíododetresañosatravésdesuparticipaciónefectivadurantelas
reunionesydesdesupaíscuandoasíserequiera.
LosEstados Parteaseguraránlaestabilidadycontinuidaddela/del
experta/odurantetodoelprocesodeevaluaciónparafacilitareldesarrollo
delastareas.Cada Estado Parte seráresponsabledelaparticipaciónde
suexperta/o.
LosEstados PartedeberáncomunicaralaSecretaríadelMESECVI
elnombreydatospersonales, talescomodirección,correoelectrónico,
teléfonoyfaxdeun/aexperta/oyde,porlomenos,una/unsuplente.Cada
Estado PartedeberácomunicarinmediatamentealaSecretaríacualquier
cambioenladesignacióndesusexpertas/osenelComité.
Artículo 3. Funciones del Comité.
DeacuerdoconloprevistoenelEstatuto,elComitéseráresponsabledel
análisistécnicodela implementacióndelaConvenciónpor losEstados
Parte. En cumplimiento de este cometido, el Comité desempeñará las
siguientesfunciones:
a.Adoptarsucronogramadetrabajoanualy lametodologíaparael
desarrollo de cada ronda de evaluación multilateral, para lo cual
la Secretaría elaborará una propuesta, de conformidad con lo
dispuestoenelartículo7a.deesteReglamento.
b.SeleccionarlasdisposicionesdelaConvencióncuyaimplementación
portodoslosEstados Parteseráobjetodeevaluación,enespecial
losartículos7y8delamisma.
c.Decidir laduracióndelperíodoquesededicaráaeste trabajo,el
cualsedenominaráronda.1

Reglamento.
e.Determinar la conformación de los subgrupos encargados de
analizarlainformaciónrecibidadelosEstados Partequelessean
asignados,deacuerdocon lodispuestoenelartículo20deeste
Reglamento.Elegiralas/oscoordinadoras/esdelossubgruposya
sussuplentessegúnseanecesario.
f.Adoptar los informes de evaluación en relación con cada Estado
Parte (informesdepaís)yel informehemisféricoalterminarcada
ronda,deacuerdoconlosprocedimientosdispuestosenlosartículos
19al24deesteReglamento,yelevarlosalaConferencia,conforme
alartículo6.2.delEstatuto.
g.Promover y facilitar la cooperación entre los Estados Parte y las
organizacionesde lasociedadcivil,asícomocon losorganismos
internacionales y agencias de cooperación, en el marco de lo
dispuestoenlaConvenciónydeacuerdoconloestablecidoenel
artículo10delEstatutoyelartículo7.n.deesteReglamento.
h.Aprobarsuinformeanualdeactividades,elcualseráremitidoala
Conferencia.
i.AnalizarperiódicamenteelfuncionamientodelMESECVIyformular
lasrecomendacionesqueconsiderepertinentesalaConferencia.
j.Solicitar laasistenciay lineamientosdelaConferencia,cuandolo
considerenecesario,paraelcumplimientodesusfunciones.
k.Aprobarelformularioparaelseguimientodelaimplementaciónde
recomendacionesalospaíses.
Artículo 4. Coordinador/a del Comité.
ElComitéelegiráporconsensoentresusmiembrosaun/aCoordinador/ay

c.Coordinar con la Secretaría las actividades relacionadas con el
funcionamientodelComité.
d.RepresentaralComitéenlaConferenciayantelosórganosdela
OEA.
e.SometeraconsideracióndelComitélaspropuestassobrecomposición
yasignacióndetareasalossubgruposqueanalizaránlainformación
recibidadelosEstados Parte.
f.LasdemásfuncionesqueleconfieraesteReglamento.
Artículo 6. Secretaría del Comité.
La Secretaría del Comité, conforme al artículo 5.4. del Estatuto, será
ejercidapor laSecretaríaGeneralde laOEA,a travésde laSecretaría
Permanentede laCIM,conelasesoramiento, cuandocorresponda,de
laComisiónInteramericanadeDerechosHumanos(CIDH)yotrasáreas
pertinentesdelaSecretaríaGeneral.

Artículo 7. Funciones de la Secretaría del Comité.
LaSecretaríacumplirálassiguientesfunciones:
a.Elaborarunproyectodecronogramadetrabajoanualquesometerá
alaconsideracióndelComité.
b.Elaborar las propuestas de metodología y cuestionario para
la evaluación de la implementación de las disposiciones de la
Convención a ser consideradas en cada ronda y someterlas
a consideración del Comité, de acuerdo con el procedimiento
dispuestoenelartículo17ysiguientes,yenparticularelartículo27
deesteReglamento.
c.Enviar simultáneamente las convocatorias de las reuniones
del Comité a las/os expertas/os y, a través de las misiones
permanentes,a lasautoridadesnacionalescompetentesy/oa las
delegadastitularesantelaCIM.
d.Preparar el proyecto de temario para cada reunión del Comité y
someterloalaaprobacióndelas/osCoordinadoras/es.
e.Prestar servicios de Secretaría al Comité y a los subgrupos
de expertas/os en todo el proceso de evaluación, incluso en la
elaboracióndelinformehemisféricoalfinaldecadaronda.
f.Elaborar, junto con el/la Coordinador/a del Comité y los
Coordinadoresdelossubgrupos,elproyectodeinformefinalque
sepresentaráalComité,deconformidadconelartículo24.
g.ElaborarelproyectodeinformeanualdeactividadesdelComitéy,
unavezésteseaaprobadoporelComité,remitirloalaConferencia.
h.CustodiartodoslosdocumentosyarchivosdelComité.
i.Difundirporcorreoelectrónico, internetocualquierotromediode
comunicación, la informaciónydocumentospúblicosrelacionados
con el MESECVI, así como los informes de país y el informe
hemisférico al final de cada ronda, una vez que éstos sean de

k.Poner en conocimiento de las/os integrantes del Comité las

l.ElaborarlasactasresumidasdelasreunionesdelComitéyllevarel
archivodelasmismas.
m.Asesoraralas/osintegrantesdelComitéeneldesempeñodesus
funcionescuandolesearequerido.
n.Promover y organizar programas de cooperación técnica, en
coordinaciónconotrasorganizaciones internacionalesyagencias
decooperación,paraapoyaralosEstados Parteensusesfuerzos
para dar cumplimiento a las recomendaciones que le formule el
Comité.
o.Elaborar el proyecto de formulario para el seguimiento de la
implementacióndelasrecomendacionesalospaísesypresentarlo
alComitéparasuaprobación.
p.Las demás que le encargue el Comité, o que correspondan a la
Secretaríaparaelefectivocumplimientodesusfunciones.
Artículo 8. Sede.
Deacuerdoconloprevistoenelartículo7.1delEstatuto,elComitétendrá
susedeenlaSecretaríaPermanentedelaCIM.
ElComitépodrácelebrarreunionesenunEstado Partedistintoal
paíssede,deconformidadconelartículo11.1delEstatuto.

Artículo 9. Autoridad nacional competente.
CadaEstado Parte designaráaunaautoridadnacionalcompetenteque
servirádeenlaceconlaSecretaríadelMESECVI.
Artículo 10. Observadores.
Deacuerdoconloprevistoenlosartículos4.1.y10.1.delEstatuto, los
EstadosMiembrosdelaOEAquenosonpartedelaConvenciónpodránser
invitadosaobservarlassesionesplenariasdelComitésiasílosolicitan.
Artículo 11. Invitadas/os especiales.
Las/losexpertas/ospuedenproponeralComité,porintermediodel/dela
Coordinador/a,laparticipacióndeinvitadas/osespecialesenlasreuniones
paraelintercambiodeinformación,experienciasymejoresprácticas.
Artículo 12. Financiamiento.Contribuciones voluntarias y subfondo
de solidaridad.
LasactividadesdelComitésefinanciarándeacuerdoconlodispuestoen
elartículo11.1delEstatuto,queestableceunfondoespecífico.
Enelmarcodelartículo11.1delEstatuto,secrearáunsubfondo
de solidaridad que asegure la participación de las/os expertas/os de
aquellospaísesque,porcircunstanciasespeciales,nopuedanfinanciar
suparticipación.Dichosubfondodesolidaridadseráadministradoporla
SecretaríadelMESECVI.
LosEstadosy/uorganismosquerealicencontribucionesfinancieras
voluntariasyaportestécnicosoenespeciedeberánexpresarclaramente
eldestinodelosmismos.Asimismo,seidentificaránrecursosadicionales
conelapoyodelasagenciasdecooperacióninternacionaly/uorganismos
multilaterales.

Artículo 13. Idiomas.

Artículo 14. Quórum.
Elquórumparasesionarseconstituiráconlapresenciadelamitadmás
unodelas/osexpertas/osqueintegranelComité.2
Artículo 15. Decisiones.
Comoreglageneral,elComitétomarásusdecisionesporconsenso.En
aquelloscasosenquesepresentencontroversiasentornoaunadecisión,
el/laCoordinador/a interpondrásusbuenosoficiosy realizará todas las
gestionesasualcanceconelfindellegaraunadecisióndeconsenso.
Agotadaestaetapaynohabiéndosellegadoaunadecisióndeconsenso,
eltemaserásometidoavotación.Siladecisiónserefierealaadopción
del informe finaldeunpaísoa lamodificacióndeesteReglamento, la
decisión se tomará por las dos terceras partes de las/os expertas/os
presentesenlareunión.3
Enlosdemáscasos,ladecisiónseadoptaráporlamitadmásuno
de las/osexpertas/ospresentesen la reunión.Enesteúltimocaso, los
votospodránserenfavor,encontraodeabstención.
Ningún/aexperto/apodráparticiparenlavotaciónsobreelproyecto
deinformedesupropiopaís.

2 La Convención Interamericana para Prevenir, Sancionar y Erradicar la Violencia contra la Mujer cuenta actualmente con 32 Estados Parte, por lo tanto, el Comité requiere de la presencia de 16 de estos Estados para poder sesionar.3 Las decisiones sobre la adopción del informe final de un país o sobre la modificación del presente Reglamento requieren del voto de los dos tercios de las/os expertas/os presentes en la sesión.Siendo actualmente 32 Estados Parte de la Convención y suponiendo que la sesión cuente con elquórum mínimo exigido por el artículo anterior (16 expertas/os), a la fecha, las dos terceras partesequivaldrían a 11 votos. Las demás decisiones se tomarán mediante el voto de la mayoría simple de las/os expertas/os presentes en la sesión.

Artículo 16. Comunicaciones y distribución de documentos.
Conelobjetodeagilizarsudistribuciónydisminuirloscostosrespectivos,
lascomunicacionesentrelaSecretaríaylas/losexpertas/osyviceversa,así
comolosdocumentosparaserconsideradosporéstos,individualmente,
enlossubgruposdeanálisisoenelplenariodelComité,seremitiránpor
correoelectrónicoysimultáneamentealaMisiónPermanenteantelaOEA
delrespectivoEstado Parte.
Las respuestas a los cuestionarios por los Estados Parte y
cualquierotrodocumentooinformacióngeneradosduranteelprocesode
evaluaciónseremitiránalaSecretaríadelComitéatravésdelasmisiones
permanentesporcorreoelectrónico,faxocorreoconvencional.
iii. ProCEdimiEnto dE EvaLuaCión muLtiLatEraL
Artículo 17. Generalidades.
Serealizaráunaprimerarondadeevaluaciónmultilateralparaelanálisis
simultáneo de los informes de todos los Estados Parte, que podrá ser
seguida de otras rondas de evaluación cuyo contenido y metodología
serándeterminadosposteriormenteporelpropioComité.
Laduracióndelasrondasserádedosaños,dedicandoelterceraño
alseguimientodelaimplementacióndelasrecomendacionesemanadas
decadaronda.
Artículo 18. Cuestionario, cronograma de trabajo y metodología de
evaluación.
La Secretaría del Comité elaborará las propuestas de cuestionario,
cronograma de trabajo y metodología para la evaluación de la
implementación de las disposiciones de la Convención y las remitirá a
las/osexpertas/osdetodoslosEstados Parte.

El Comité adoptará las versiones finales del cuestionario, el
cronogramadetrabajoylametodologíadeevaluación.
LaSecretaríadelComitéremitiráloscuestionariosalaautoridad
nacional competente encargada de coordinar la respuesta del Estado
Parteyalasmisionespermanentes.
Artículo 19. Respuesta de los Estados Parte al cuestionario.
Los Estados Parte deberán hacer llegar a la Secretaría del Comité, a
travésde lasmisionespermanentes, la respuestaal cuestionario en la
fechaestablecida,acompañadodeuninformeejecutivosobrelasituación
de la violencia contra lamujerensupaís, los logros,dificultadesy las
áreasenlasqueconsiderequelacooperaciónpodríaserfortalecida.
Artículo 20. Subgrupos para el análisis de la información y la elaboración
de los informes preliminares.
ElComité, conbaseenunapropuestaelaboradapor laSecretaría, en
colaboración con el/la Coordinador/a, conformará los subgrupos de
análisisyasignarálostrabajosenformaaleatoriatomandoencuentala
tradiciónjurídicadelosEstadosanalizados,larepresentaciónregional,el
equilibrioidiomáticoyladistribuciónequitativadetrabajoentretodas/os
las/losexpertas/os.
Lossubgruposredactaránlosinformespreliminaresdepaís,que
seránposteriormentesometidosaconsideracióndelplenariodelComité.
Ningún/aexperto/apodráparticiparenlaelaboracióndelinforme
preliminardesupropiopaís.
Artículo 21. Análisis de la información y elaboración del informe preliminar.
Unavezrecibidalarespuestaalcuestionarioseprocederádelasiguiente
forma:

a.ConelapoyodelaSecretaría,cadaexperta/omiembrodecadauno
delossubgruposdeanálisisrecibiráyanalizará,previoalareunión
delComité,lainformaciónrecibidadelosEstados Partequesele
hayanasignadoasusubgrupoyelaboraráelproyectodeinforme
preliminar de un país que le será comunicado, para su posterior
análisisenelsubgrupo.
b.Finalizada la reunión de los subgrupos de análisis, los proyectos
de informe preliminar serán debatidos en el plenario, conforme
al artículo 23 del presente Reglamento. La Secretaría enviará el
informepreliminaralaautoridadnacionalcompetenteyalaMisión
PermanentecorrespondienteparaquepresentealaSecretaríalos
comentarios o aclaraciones que considere pertinentes dentro del
plazoqueelComitéestablezca.Esta informaciónseráenviadaa
las/osexpertas/osdelsubgrupodeanálisisparasudiscusiónenla
siguientereunión.
c.ConbaseenlasrespuestasdelEstado Parte analizadoalinforme
preliminar,la/elexperta/oencargada/odesuestudioelaboraráuna
versión revisadadelmismoy la remitiráa las/osexpertas/osque
integranelsubgrupodeanálisis,porlomenostreinta(30)díasantes
de la siguiente reunióndel Comité, que lo considerará en sesión
plenaria.
Artículo 22. Extensión y forma de los informes de país.
ElComitéconsideraráyaprobarálaestructuradelosinformesdepaísde
conformidadcon lasmodalidadesquehayansidoaprobadasparacada
ronda. Todos los informes de país tendrán la misma estructura, serán
concisosynoexcederánlasveinte(20)páginas.

Artículo 23. Consideración y aprobación de los informes de país.
Paralaconsideraciónyadopcióndelosinformesdepaísseprocederáde
lasiguienteforma:
a.Todos las/os expertas/os tendrán acceso a las respuestas de los
cuestionariosyaloscomentariospresentadosporlosEstados Parte.
b.Los subgruposdeanálisis examinarán la versión revisadade los
informespreliminarescorrespondientesyprepararánlosproyectos
de informe de país, que la/el experta/o asignada/o presentará al
plenariodelComitéparasuexamen.
c.El Comité en pleno podrá hacer los cambios que considere
necesariosalosproyectosdeinformedepaís,quecontendránlas
conclusionesyrecomendacionesqueseestimenpertinentes.
d.LaSecretaríacorregirálosproyectosdeinformedepaísenlaforma
queloacuerdeelComitéylospresentaráparasuaprobación.
e.Unavezaprobadoslosinformesdepaís,seremitiránalaautoridad
nacionalcompetenteyalaMisiónPermanentecorrespondiente.Los
Estados Partepodránpresentarobservacionesadicionalesdentro
delplazoestablecidoporelComité.
Artículo 24. Informe final.
Al concluir una ronda completa de evaluación, el Comité adoptará un
informe final que incluya los informes de país y las observaciones de
losEstados Parte.Deigualforma,incluiráunanálisisgeneraleintegral
(informe hemisférico) que identifique las fortalezas y debilidades en la
implementacióndelaConvención.
El informe hemisférico contendrá, entre otras, las conclusiones
y recomendaciones del Comité, con base en los informes de país,
para fortalecer la cooperación hemisférica en la implementación de la
Convención,enparticularlasdisposicionesconsideradasendicharonda.

El/la Coordinador/a del Comité presentará el informe final a la
ConferenciayposteriormenteserápublicadoyseelevaráaAsambleade
DelegadasdelaCIMyalaAsambleaGeneraldelaOEA.
iv. sEguimiEnto
Artículo 25. Seguimiento.
Elseguimientodelaimplementacióndelasrecomendacionesseefectuará
enelañocalendariosiguientealaaprobacióndelosinformesdepaís.
La Secretaría del MESECVI enviará a cada Estado Parte el
formularioaprobadoporelComitéparaelseguimientodelaimplementación
delasrecomendacionesalospaísesparaqueindiqueelprogresologrado
al respecto, en la fecha que determine el Comité, de conformidad a lo
dispuestoenelartículo7.o.delpresenteReglamento.
Las respuestas de los países incluirán las medidas específicas
adoptadasparaavanzaren la implementacióndecadarecomendación.
Lospaísespueden indicar susnecesidadesdeasistencia técnicaode
otraíndolerelacionadasconlaimplementacióndelasrecomendaciones.
La Secretaría compilará las respuestas en un documento
preliminar, queelComité utilizaráparaelaborarel proyectode informe
sobre la implementación de las recomendaciones, de conformidad a lo
dispuestoenelartículo7.o.delpresenteReglamento.
El proyecto de informe sobre la implementación de las
recomendacionesdeberásometersealaaprobacióndelaConferencia,el
cualunavezhechopúblicoseelevaráalaAsambleadeDelegadasdela
CIMyalaAsambleaGeneraldelaOEA.
Artículo 26. Informes en el marco de las reuniones plenarias del Comité.
Al comienzo de las reuniones del Comité, cada Estado Parte podrá
presentarporescrito informaciónsobre lasmedidasadoptadasentre la
ConvenCión interameriCana para prevenir, SanCionar y erradiCar la violenCia Contra la mujer
o ConvenCión de Belém do pará y Su eStatuto de meCaniSmo de Seguimiento 51

reuniónanteriorylaqueseiniciaconmirasaavanzarenlaimplementación
delaConvención.LaSecretaríasiempreincluiráestepuntocomoparte
delproyectodetemarioparacadareunióndelComité.
v. PartiCiPaCión dE Las organizaCionEs dE La soCiEdad CiviL
Artículo 27. Participación de las organizaciones de la sociedad civil.
Unavezpublicadoslosdocumentoscorrespondientesalosproyectosde
cuestionarioymetodologíadetrabajo,asícomocualquierotrodocumento
públicoqueelComitéconsidereapropiadodifundir,lasorganizacionesde
lasociedadcivil,teniendoencuentalas“Directrices para la participación
de las organizaciones de la sociedad civil en las actividades de la OEA”
(CP/RES759(1217/99))podrán:
a.Presentar,atravésdelaSecretaría,propuestasespecíficasparaque
seanconsideradasenelprocesodedefinicióndelosdocumentos
mencionadosenelpárrafoanterior.Estaspropuestasdeberánser
presentadasconcopiaelectrónicadentrodelplazoestablecidopor
laSecretaríaytendráncarácterpúblico.
b.Presentar, a través de la Secretaría, información específica
directamenterelacionadaconelcuestionarioyconlaimplementación
delasdisposicionesdelaConvenciónanalizadasenlaronda.Esta
información deberá ser presentada con copia electrónica dentro
del mismo plazo que el establecido para que los Estados Parte
respondanalcuestionario.
La Secretaría distribuirá la información que cumpla con las
condiciones y plazos dispuestos en este artículo tanto al Estado
Parteanalizadocomoalas/osexpertas/osdelsubgrupodeanálisis
correspondiente.

c.Presentarpropuestasenrelaciónconlostemasdeinteréscolectivo
de las reuniones del Comité. Estas propuestas deberán ser
presentadasatravésdelaSecretaría,concopiaelectrónica,amás
tardarunmesantesdelafechadelareuniónenlaqueelComité
considerarádichostemas.
LaSecretaríadistribuiráestaspropuestasalosEstados Parte ya
las/osexpertas/os.
Artículo 28. Distribución de la información y propuestas de las
organizaciones de la sociedad civil.
La información y propuestas presentadas por las organizaciones de la
sociedad civil, de acuerdo con lo dispuesto en el artículo anterior, se
distribuiránenlosidiomasenqueseanpresentadas.
Lainformaciónylaspropuestaspresentadasporlasorganizaciones
delasociedadcivilquenoesténenversiónelectrónicasedistribuiránen
la reunión del Comité cuando éstas no excedan las diez (10) páginas.
Cuandoexcedanesenúmerodepáginas,lasrespectivasorganizaciones
de lasociedadcivildeberánhacer llegara laSecretaríacopiasparasu
distribución.
Artículo 29. Participación de las organizaciones de la sociedad civil
en las reuniones del Comité.
El Comité podrá aceptar las solicitudes de las organizaciones de la
sociedadcivilparapresentarverbalmente,antesdeliniciodelareunión
formaldelComité,lainformaciónypropuestasquehubierenhechollegar
deconformidadconelartículo28deesteReglamento.ElComitédecidirá
laduracióndeestaspresentacionesverbales.

theirhumanrightsandfundamentalfreedoms,andimpairsornullifiesthe
observance,enjoymentandexerciseofsuchrightsandfreedoms;
conceRned that violence against women is an offense against
human dignity and a manifestation of the historically unequal power
relationsbetweenwomenandmen;
RecAlling theDeclarationontheEliminationofViolenceagainst
Women,adoptedbytheTwenty-fifthAssemblyofDelegatesoftheInter-
American Commission of Women, and affirming that violence against
womenpervadeseverysectorofsocietyregardlessofclass,raceorethnic

Article 1.For thepurposesof thisConvention,violenceagainstwomen
shallbeunderstoodasanyactorconduct,basedongender,whichcauses
deathor physical, sexual or psychological harmor suffering towomen,
whetherinthepublicortheprivatesphere.
Article 2. Violenceagainstwomenshallbeunderstoodtoincludephysical,
sexualandpsychologicalviolence:
a)that occurs within the family or domestic unit or within any other
interpersonalrelationship,whetherornottheperpetratorsharesor
hassharedthesameresidencewiththewoman,including,among
others,rape,batteryandsexualabuse;
b)that occurs in the community and is perpetrated by any person,
including,amongothers, rape,sexualabuse, torture, trafficking in
persons, forcedprostitution,kidnappingandsexualharassment in
theworkplace,aswellasineducationalinstitutions,healthfacilities
oranyotherplace;and
c)thatisperpetratedorcondonedbythestateoritsagentsregardless
ofwhereitoccurs.

Article 4. Every woman has the right to the recognition, enjoyment,
exercise and protection of all human rights and freedoms embodied in
regionalandinternationalhumanrightsinstruments.Theserightsinclude,

Article 6. The right of every woman to be free from violence includes,
amongothers:
a)Therightofwomentobefreefromallformsofdiscrimination;and
b)Therightofwomentobevaluedandeducatedfreeofstereotyped
patterns of behavior and social and cultural practices based on
conceptsofinferiorityorsubordination.
ChaPtEr iiidutiEs of thE statEs
Article 7.TheStatesPartiescondemnallformsofviolenceagainstwomen
andagreetopursue,byallappropriatemeansandwithoutdelay,policies
toprevent,punishanderadicatesuchviolenceandundertaketo:
a)refrain from engaging in any act or practice of violence against
women and to ensure that their authorities, officials, personnel,
agents,andinstitutionsactinconformitywiththisobligation;
b)applyduediligencetoprevent,investigateandimposepenaltiesfor
violenceagainstwomen;
c)include in their domestic legislation penal, civil, administrative and
anyothertypeofprovisionsthatmaybeneededtoprevent,punish
and eradicate violence against women and to adopt appropriate
administrativemeasureswherenecessary;
d)adopt legal measures to require the perpetrator to refrain from
harassing,intimidatingorthreateningthewomanorusinganymethod
thatharmsorendangersherlifeorintegrity,ordamagesherproperty;

e)take all appropriate measures, including legislative measures, to
amendorrepealexistinglawsandregulationsortomodifylegalor
customarypracticeswhichsustainthepersistenceandtoleranceof
violenceagainstwomen;
f)establish fair and effective legal procedures for women who
have been subjected to violence which include, among others,
protectivemeasures,atimelyhearingandeffectiveaccesstosuch
procedures;
g)establish the necessary legal and administrative mechanisms to
ensurethatwomensubjectedtoviolencehaveeffectiveaccessto
restitution,reparationsorotherjustandeffectiveremedies;and
h)adoptsuch legislativeorothermeasuresasmaybenecessary to
giveeffecttothisConvention.
Article 8. The States Parties agree to undertake progressively specific
measures,includingprograms:
a)topromoteawarenessandobservanceoftherightofwomentobe
freefromviolence,andtherightofwomentohavetheirhumanrights
respectedandprotected;
b)tomodifysocialandculturalpatternsofconductofmenandwomen,
including the development of formal and informal educational
programsappropriatetoeveryleveloftheeducationalprocess,to
counteract prejudices, customs and all other practices which are
basedontheideaoftheinferiorityorsuperiorityofeitherofthesexes
oronthestereotypedrolesformenandwomenwhichlegitimizeor
exacerbateviolenceagainstwomen;
c)topromote theeducationand trainingof all those involved in the
administrationofjustice,policeandotherlawenforcementofficers
as well as other personnel responsible for implementing policies

d)toprovideappropriatespecializedservicesforwomenwhohavebeen
subjected toviolence, throughpublicandprivatesectoragencies,
includingshelters,counselingservicesforailfamilymemberswhere
appropriate,andcareandcustodyoftheaffectedchildren;
e)topromoteandsupportgovernmentalandprivatesectoreducation
designed to raise theawarenessof thepublicwith respect to the
problemsofandremediesforviolenceagainstwomen;
f)toprovidewomenwhoaresubjectedtoviolenceaccesstoeffective
readjustmentandtrainingprogramstoenablethemtofullyparticipate
inpublic,privateandsociallife;
g)to encourage the communications media to develop appropriate
mediaguidelinesinordertocontributetotheeradicationofviolence
againstwomeninallitsforms,andtoenhancerespectforthedignity
ofwomen;
h)toensureresearchandthegatheringofstatisticsandotherrelevant
information relating to the causes, consequences and frequency
ofviolenceagainstwomen,inordertoassesstheeffectivenessof
measurestoprevent,punishanderadicateviolenceagainstwomen
andtoformulateandimplementthenecessarychanges;and
i)to foster international cooperation for the exchange of ideas and
experiences and the execution of programs aimed at protecting
womenwhoaresubjectedtoviolence.
Article 9. WithrespecttotheadoptionofthemeasuresinthisChapter,the
StatesPartiesshalltakespecialaccountofthevulnerabilityofwomento
violencebyreasonof,amongothers,theirraceorethnicbackgroundortheir

statusasmigrants,refugeesordisplacedpersons.Similarconsideration
shallbegiventowomensubjectedtoviolencewhilepregnantorwhoare
disabled,ofminorage,elderly,socioeconomicallydisadvantaged,affected
byarmedconflictordeprivedoftheirfreedom.
ChaPtEr ivintEr-amEriCan mEChanisms of ProtECtion
Article 10. Inorder toprotect the rightofeverywoman tobe free from
violence, theStatesPartiesshall include in theirnational reports to the
Inter-AmericanCommissionofWomeninformationonmeasuresadoptedto
preventandprohibitviolenceagainstwomen,andtoassistwomenaffected
byviolence,aswellasonanydifficultiestheyobserveinapplyingthose
measures,andthefactorsthatcontributetoviolenceagainstwomen.
Artículo 11.TheStatesPartiestothisConventionandtheInter-American
CommissionofWomenmayrequestoftheInter-AmericanCourtofHuman
RightsadvisoryopinionsontheinterpretationofthisConvention.
Artículo 12. Any person or group of persons, or any nongovernmental
entitylegallyrecognizedinoneormorememberstatesoftheOrganization,
maylodgepetitionswiththeInter-AmericanCommissiononHumanRights
containing denunciations or complaints of violations of Article 7 of this
Convention by a State Party, and the Commission shall consider such
claimsinaccordancewiththenormsandproceduresestablishedbythe
AmericanConventiononHumanRightsandtheStatutesandRegulations
of the Inter-American Commission on Human Rights for lodging and
consideringpetitions.

ChaPtEr vgEnEraL Provisions
Article 13.NopartofthisConventionshallbeunderstoodtorestrictorlimit
thedomesticlawofanyStatePartythataffordsequalorgreaterprotection
and guarantees of the rights of women and appropriate safeguards to
preventanderadicateviolenceagainstwomen.
Article 14.Nopartof thisConventionshallbeunderstood to restrictor
limittheAmericanConventiononHumanRightsoranyotherinternational
conventiononthesubjectthatprovidesforequalorereaterprotectionin
thisarea.
Article 15.ThisConventionisopentosignaturebyallthememberStates
oftheOrganizationofAmericanStates.
Article 16. This Convention is subject to ratification. The instruments
of ratification shall be deposited with the General Secretariat of the
OrganizationofAmericanStates.
Article 17. This Convention is open to accession by any other state.
InstrumentsofaccessionshallbedepositedwiththeGeneralSecretariat
oftheOrganizationofAmericanStates.
Article 18.AnyStatemay,atthetimeofapproval,signature,ratification,
or accession, make reservations to this Convention provided that such
reservationsare:
a)notincompatiblewiththeobjectandpurposeoftheConvention,and
b)notofageneralnatureandrelatetooneormorespecificprovisions.

Article 19.AnyStatePartymaysubmittotheGeneralAssembly,through
theInter-AmericanCommissionofWomen,proposalsfortheamendment
ofthisConvention.
Amendmentsshallenterintoforceforthestatesratifyingthemon
the date when two-thirds of the States Parties to this Convention have
depositedtheir respective instrumentsofratification.Withrespect to the
otherStatesParties,theamendmentsshallenterintoforceonthedates
onwhichtheydeposittheirrespectiveinstrumentsofratification.
Article 20. IfaStatePartyhastwoormoreterritorialunits inwhichthe
mattersdealtwithinthisConventionaregovernedbydifferentsystemsof
law,itmay,atthetimeofsignature,ratificationoraccession,declarethat
thisConventionshallextendtoallitsterritorialunitsortoonlyoneormore
ofthem.
Suchadeclarationmaybeamendedatanytimebysubsequent
declarations, which shall expressly specify the territorial unit or units to
which this Convention applies. Such subsequent declarations shall be
transmitted to the General Secretariat of the Organization of American
States,andshallenterintoforcethirtydaysafterthedateoftheirreceipt.
Article 21.ThisConventionshallenterintoforceonthethirtiethdayafter
thedateofdepositofthesecondinstrumentofratification.ForeachState
thatratifiesoraccedestotheConventionafterthesecondinstrumentof
ratificationisdeposited,itshallenterintoforcethirtydaysafterthedateon
whichthatStatedepositeditsinstrumentofratificationoraccession.
Article 22. The Secretary General shall inform all member states
of the Organization of American States of the entry into force of this
Convention.

shallpresentanannualreporttothememberstatesoftheOrganizationonthe
statusofthisConvention,includingthesignatures,depositsofinstruments
ofratificationandaccession,anddeclarations,andanyreservationsthat
mayhavebeenpresentedbytheStatesParties,accompaniedbyareport
thereonifneeded.
Article 24.ThisConventionshall remain in force indefinitely,butanyof
theStatesPartiesmaydenounce it bydepositingan instrument to that
effectwiththeGeneralSecretariatoftheOrganizationofAmericanStates.
Oneyearafterthedateofdepositoftheinstrumentofdenunciation,this
ConventionshallceasetobeineffectforthedenouncingStatebutshall
remaininforcefortheremainingStatesParties.
Article 25.TheoriginalinstrumentofthisConvention,theEnglish,French,
Portuguese and Spanish texts of which are equally authentic, shall be
depositedwith theGeneralSecretariat of theOrganizationofAmerican
States,whichshallsendacertifiedcopytotheSecretariatoftheUnited
Nationsforregistrationandpublicationinaccordancewiththeprovisions
ofArticle102oftheUnitedNationsCharter.
INWITNESSWHEREOFtheundersignedPlenipotentiaries,being
duly authorized thereto by their respective governments, have signed

TakingintoaccountthatthepurposeoftheInter-AmericanConventionon
thePrevention,Punishment,andEradicationofViolenceagainstWomen
“ConventionofBelémdoPará” is toprotectwomen’shumanrightsand
eliminateviolentsituations thatmayaffect them,becauseeverywoman
hastherighttoalifefreefromviolenceinbothpublicandprivatespheres,
it is necessary to strengthen cooperation among the States Parties to
develop the necessary mechanisms, policies, programs, and plans to
prevent,punish,anderadicateviolenceagainstwomen;
Recognizing, that there has already been significant progress
in the implementationof theprovisionsof the "ConventionofBelémdo
Pará", at both the international andnational levels, throughprogress in
the internal legalsystemsof theStatesPartiesand thedevelopmentof
policies,programs,andplans implementedby thenationalagencies for
womenandotherstateinstitutionsandagencies;
Stressing,thattheexistenceofamechanismtopermitfollow-up
andanalysisofthewaysinwhichtheConventionisbeingapplied,andto
facilitatecooperationamongtheStatesPartiesandalloftheOASmember
states,wouldcontributetofulfillmentofitsobjectives;
CarryingoutthemandatesadoptedbytheThirty-firstMeetingof
the Assembly of Delegates of the CIM [CIM/RES. 224 (XXXI-O/02)] to
begin a process to establish the most appropriate way to follow up on
the“ConventionofBelémdoPará”,andbytheGeneralAssemblyofthe

The Conference of States Parties agrees upon the following
Mechanismforfollow-uponimplementationofthe“ConventionofBelém
doPará”:
Article 1. Purposes / objectives
1.1 ThepurposesoftheMechanismshallbe:
a.TofollowuponthecommitmentsundertakenbytheStatesParties
totheConventionandreviewhowtheyarebeingimplemented;
b.TopromotetheimplementationoftheConventionandcontributeto
achievementoftheobjectivesestablishedtherein.
c.Toestablisha systemof technical cooperationamong theStates
Parties,whichshallbeopentoothermemberStatesandpermanent
observerStates,fortheexchangeofinformation,experiences,and

legislation, as appropriate, and attain other common objectives

Article 2. Basic principles
2.1 The Mechanism for follow-up of the commitments assumed by
the States Parties to the Convention will be developed within
the framework of the purposes and principles established in the
CharteroftheOrganizationofAmericanStates.Inthisregard,the
characteristics of this Mechanism and the procedures used must
takeaccountof theprinciplesof sovereignty,nonintervention, the
juridicalequalityofstates,andtheneedtorespecttheconstitution
andbasicprinciplesofthelegalsystemofeachStateParty.

Article 3. Nature
3.1 TheMechanismforfollow-upoftheimplementationoftheConvention
isintergovernmental,andhasthefollowingcharacteristics:
a.It shall be impartial and objective in its functioning and in the
conclusionsandrecommendationsitissues.
b.ItshallguaranteefairapplicationandequaltreatmentfortheStates
Parties.
c.ItmayissuerecommendationstotheStatesPartiesandfollowupon
theirimplementation.
d.It shall operate on the basis of consensus and the principle of
cooperationamongtheStatesParties.
e.Itshallestablishanappropriatebalancebetweentheconfidentiality
oftheevaluationandthetransparencyoftheprocess.
Article 4. Members
4.1 AlltheStatesPartiestotheConventionshallbemembersandshall
berepresentedandparticipateintheFollow-upMechanism.Member
StatesoftheOASthatarenotpartiestotheConventionmaytake
partasobservers,iftheysorequest.
Article 5. Structure
5.1 The Follow-up Mechanism shall consist of two organs: the
ConferenceofStatesParties(hereinafter“theConference”)andthe
CommitteeofExperts(hereinafter“theCommittee”).
5.2 TheConference is thepoliticalorganof theMechanism,shallbe
comprisedofrepresentativesofallStatesPartiestotheConvention,
and shall hold a regular meeting every two years and special
meetingsasoftenasitdeemsnecessary.

5.3 TheCommitteeisthetechnicalorganoftheMechanismandshall
becomprisedofexpertsintheareacoveredbytheConvention,who
shallperform their functions in theirpersonalcapacity.Theyshall
beappointedbyeachStateParty to theConvention fromamong
itsnationals.TheCommitteeshallmeetinaccordancewithitsown
workplanandprocedures.
5.4 TheSecretariatoftheConferenceandoftheCommitteeshallbe
the OAS General Secretariat, through the Permanent Secretariat
oftheCIM,andwithadvisoryservices,whenappropriate,fromthe
Inter-AmericanCommissiononHumanRights(IACHR).
Article 6. Responsibilities
6.1 TheresponsibilitiesoftheConferenceare:
a.EstablishoverallguidelinesfortheworkoftheCommitteeandserve
asitsadvisorybody;
b.Receive,analyze,andevaluatethereportsoftheCommittee;
c.Publish and disseminate the final report of the Mechanism, in
coordinationwiththeOASGeneralSecretariat;
d.SettleanymatterrelatingtotheoperationsoftheMechanism.
6.2 TheresponsibilitiesoftheCommitteeare:
a.Draftitownrulesofprocedure;
b.Defineitsworkingmethodsandworkcalendar;
c.ReceiveandevaluatethereportsoftheStatesPartiesandissueits
recommendations;
d.PresenttheitsreportstotheConference.
Article 7. Headquarters
7.1 The Follow-up Mechanism shall have its headquarters at the
OrganizationofAmericanStates, in thePermanentSecretariat of
theCIM.

Article 8. Operations
8.1 Selectionofprovisionsandmethodology:
a.The Committee Secretariat shall submit to the Committee, for its
consideration, a document in which it will select the Convention
provisions whose application by the States Parties could be the
subject of the review and, in keeping with available financial
resources,shalldeterminethedurationofaperiodofsessionsitwill
devotetothistask--tobecalledaround--andthenumberofreports
tobeconsideredateachmeeting.
b.During each round, the Committee Secretariat shall prepare a
questionnaireontheprovisionsithasselected.Thequestionnaire,
onceapprovedbytheCommittee,shallbetransmittedtotheStates
Parties, who undertake to reply to it by the deadline set by the
Committee. Replies to the questionnaire shall be circulated to all
membersoftheCommittee.
c.Atthestartofeachround,theCommitteeshallexaminetheinformation
of each State Party and establish a calendar for the review, in a
predetermined, impartial manner, such as alphabetical order, the
drawingoflots,orchronologicalorderofratificationoftheConvention.
TheCommitteeSecretariatshallmakethisinformationpublic.
d.In order to fulfill its functions, the Committee shall determine the
appropriatemethodforcarryingoutitsworkplan.
8.2 Finalreport:
a.Afterreviewingthereportsofall theStatesParties ineachround,
the Committee shall issue a final report with the corresponding
recommendations;thisreportshallincludetheobservationsoneach
StateParty thathasbeenreviewedandshallbesubmitted to the
Conferenceand,oncepublished,totheAssemblyofDelegatesof
theCIM.

8.3. Follow-upofrecommendations:
a.TheCommitteeshalldeterminethenecessarymeanstofollow-up
on fulfillmentof the recommendationsmade in the final report on
eachStateParty.
Article 9. Equal treatment
9.1 To ensure that the mechanism is efficient and consists of an
evaluationbetweenequals,theobjectiveofwhichistostrengthen
communication and exchange of experiences among the States
Parties,theCommitteeofExpertsshalltakeintoaccountthat:
a.AllStatesPartiesshallbereviewedintheframeworkoftheround,in
accordancewithidenticalcriteriaandprocedures.
b.ThesamequestionnaireshallbeusedforallStatesParties.
c.AlltheStatePartyreportsshallhavethesameformat.
Article 10. Intergovernmental cooperation and participation of civil
society
10.1 The Conference of States Parties and the Committee of Experts
of theConventionFollow-upMechanismare intergovernmental in
nature.TheConferenceandtheCommitteeofExpertsmayinviteto
itsplenarymeetingsstatesthatarenotpartiestotheConvention.
10.2 In order to secure more input for its reviews, the Committee shall
include,initsrulesofprocedure,provisionsthatensureparticipation
by civil society organizations, in particular those that deal with the
subject of the "Convention of Belém do Pará", in keeping with the
principles set forth in the Guidelines for the Participation of Civil
SocietyOrganizationsinOASActivities[CP/RES.759(1217/99)]and
thedefinitionof civil society contained in resolutionAG/RES.1661
(XXIX-O/99).

10.3 Bearing in mind the objectives of the Follow-up Mechanism, and
intheframeworkof theInter-AmericanProgramonthePromotion
of Women’s Human Rights and Gender Equity and Equality, the
Committee shall cooperate with all OAS member states that so
request, taking into account OAS activities in progress, and shall
reporttotheConferenceonthismatter.
10.4 The States Parties shall establish mechanisms that facilitate
cooperationandtechnicalassistancefortheexchangeofinformation,
experiences,andbestpracticestobringaboutthefullimplementation
oftheConvention.
Article 11. Resources
11.1 Theactivitiesof theFollow-upMechanismshall be financedbya
specificfundestablishedforthispurpose,consistingofcontributions
fromStatesPartiestotheConvention,statesthatarenotpartiestothe
Convention,permanentobserverstates,andinternationalfinancial
agencies, other external resources, and any other contribution it
mayreceive inaccordancewith theGeneralStandardstoGovern
the Operations of the General Secretariat of the Organization of
American States. These contributions may include offers from
StatesParties toorganizeandhostmeetingsof theMechanism’s
organs.
11.2 The Conference may establish criteria for determining regular
contributions.
Article 12. Review of the Mechanism
12.1 TheConferenceshallperiodicallyreviewtheMechanism’soperation,
taking intoaccount theobservationsof theCommitteeofExperts,
andmayintroduceanychangesitdeemsappropriate.

Article 13. Report to the OAS General Assembly
13.1 The Conference, in collaboration with the Committee Secretariat,
shall report every two years to the OAS General Assembly on
workdoneduringthatperiodconcerningprogress,challenges,and
bestpractices thatemerge from the final reports it issues,and, if
appropriate,shallissuegeneralrecommendations,ifitseesfit.
Article 14. Transitory provision
14.1 This Statute shall enter into force on the date of its adoption by
those States that have deposited their instrument of ratification of
theInter-AmericanConventiononthePrevention,Punishment,and
EradicationofViolenceagainstWomen, “ConventionofBelémdo
Pará”.

i. sCoPE of thE ruLEs of ProCEdurE
Article 1. Scope of the Rules of Procedure.
TheRules of Procedureshallprescribethestructureandworkingsofthe
Committee of Experts (hereafter, the Committee) of the Mechanism for
Follow-upontheImplementationoftheInter-AmericanConventiononthe
Prevention, Punishment, and Eradication of Violence against Women,
“Convention of Belém do Pará” (hereafter, MESECVI) (hereafter, the
Convention).
As the technical organ of the Mechanism, the Committee shall
haveundertakeitsactivitieswithintheframeworkofthepurposes,basic
principles,characteristicsandotherprovisionsestablishedinthe“Statuteof
theMechanismforFollow-upontheImplementationoftheInter-American
ConventiononthePrevention,Punishment,andEradicationofViolence
againstWomen,‘ConventionofBelémdoPará’”(hereafter,theStatute),
ofthedecisionsadoptedbytheConferenceofStatesParties(hereafter,
theConference)and,asappropriate,oftheCharteroftheOrganizationof
AmericanStates(OAS).
TheCommitteemayresolvethosemattersnotaddressedbythese
Rules,theStatuteortheOASCharterinconsultationwiththeConference.
ii. struCturE and Workings of thE CommittEE of ExPErts
Article 2. Composition of the Committee.
TheCommitteeshallbecomposedofexpertsinthemattersencompassed
bytheConvention.TheexpertsshallbeappointedbyeachoftheStates
Parties to said Convention and shall exercise their responsibilities in a
mannerthatisindependentandautonomousandinanindividualcapacity.
Expertswillnotparticipateintheevaluationoftheirowncountries.

TheprincipalandalternateCommitteeexpertsshouldhavesolid
technicalexpertiseandexperience in thevariousmattersaddressedby
theConvention.
Theexpertshallserveforatermofatleastthreeyearsbyattending
meetingsoftheCommitteeinperson,orfromhisorhercountry,whenso
required.
Inordertofacilitatetheprogressofactivities,States Partiesshall
ensurethestabilityandcontinuityoftheexpertsthroughouttheevaluation
process.EachState Partyshallberesponsiblefortheparticipationofits
expert.
The States PartiesshallnotifytheSecretariatofMESECVIofthe
nameornamesandpersonal information(address,e-mailaddress,and
telephoneandfaxnumbers)ofoneexpertandatleastonealternate.Each
State PartyshallnotifytheSecretariatimmediatelyofanychangesinthe
designationofitsexpertsontheCommittee.
Article 3. Responsibilities of the Committee.
InaccordancewiththeStatute,theCommitteeshallberesponsibleforthe
technicalanalysisoftheimplementationoftheConventionbytheStates
Parties. In performing this function, the Committee shall undertake the
following:
a.Adopt itsannualworkplanandmethodology foreachmultilateral
evaluation round, for which the Secretariat will develop a draft in
conformity with the provisions contained in Article 7.a of these
Rules.
b.Select,fromamongtheprovisionsoftheConvention,thosewhose
implementation by all of the States Parties shall be reviewed, in
particularinArticles7and8.

c.Determinethelengthoftimeitshalldevotetothistask,whichshall
beknownasa“round”.1
d.Adoptaquestionnaireontheprovisionsselectedforreviewineach
roundandinaccordancewithArticle18oftheseRules.
e.Determinethecompositionofsubgroupstoanalyzetheinformation
receivedfromtheStates Partiestheyhavebeenassignedtoreview,
pursuant toArticle20of theseRules.CoordinatorsandAlternate
Coordinatorsofsubgroupsshallbeelectedasnecessary.
f.Adopt evaluation reports in regard to each of the States Parties
(countryreports)andahemisphericreportattheendofeachround,
inaccordancewiththeproceduresestablishedinArticles19to24of
theseRules,andsubmitthemtotheConference,pursuanttoArticle
6.2oftheStatute.
g.Promote and facilitate cooperation among the States Parties and
civilsocietyorganizationsandwith internationalorganizationsand
cooperationagencies,withintheframeworkoftheConventionand
inaccordancewithArticle10oftheStatuteandArticle7.nofthese
Rules.
h.Adopt a yearly activity report, which shall be forwarded to the
Conference.
i.Review periodically the operation of the MESECVI and propose
suchrecommendationsasitdeemspertinenttotheConference.
j.Request assistance and guidance from the Conference when it
considersitnecessaryinordertofulfillitsresponsibilities.
k.Approvetheformtobeusedforfollow-upofimplementationofthe
recommendationstocountries.

Article 4. Committee Coordinator.
The Committee shall elect by consensus from among its members a
CoordinatorandanAlternateCoordinator,withregardfortheprincipleof
geographicalrepresentation.Ifnoconsensusisreached,electionshallbe
bysimplemajorityoftheCommitteemembers.TheAlternateCoordinator
shallassisttheCoordinatorintheperformanceofhisorheractivities.The
CoordinatorandAlternateCoordinatorshallserveforatwo-yeartermand
maybereelectedforoneadditionalterm.Inthetemporaryabsence,or
impediment,of theCoordinator, theAlternateCoordinatorshallassume
theresponsibilitiesoftheCoordinatorandtheCommitteeshallelectanew
AlternateCoordinator.
Article 5. Responsibilities of the Coordinator.
a.Openandadjournplenarymeetingsanddirectthediscussions.
b.SubmittheitemsontheagendaforconsiderationbytheCommittee,
includingatopicthatheorsheconsiderstobeofcollectiveinterest,
togetherwithamethodologyforaddressingit.
c.CoordinatewiththeSecretariattheactivitiesrelatedtotheworkings
oftheCommittee.
d.RepresenttheCommitteebeforetheConferenceandOASorgans.
e.Submit to the Committee for its consideration proposals on the
composition and tasking of the subgroups that will analyze the
informationreceivedfromtheStates Parties.
f.AllotherresponsibilitiesconferredbytheseRules.
Article 6. Secretariat of the Committee.
PursuanttoArticle5.4oftheStatute,theOASGeneralSecretariat,through
thePermanentSecretariatoftheCIM,shallserveastheSecretariatofthe
Committee,withadvisoryservicesprovided,asappropriate,bytheInter-

AmericanCommissiononHumanRights(IACHR)orotherrelevantareas
oftheGeneralSecretariat.
Article 7. Responsibilities of the Secretariat of the Committee.
TheSecretariatshallhavethefollowingresponsibilities:
a.PrepareanannualdraftworkplanoftheCommitteeandsubmititto
theCommitteeforconsideration.
b.Prepare the methodology and questionnaire proposals for the
evaluationoftheimplementationoftheprovisionsoftheConvention
tobeconsideredineachround,andsubmitthemtotheCommittee
forconsideration,inaccordancewithArticle17andfollowingarticles,
especiallyArticle27,oftheseRules.
c.SendsimultaneousconvocationnoticesforCommitteemeetingsto
theexpertsand,throughthepermanentmissions,tothecompetent
nationalauthoritiesand/orprincipaldelegatestotheCIM.
d.PreparethedraftagendaforeachCommitteemeetingandsubmitit
totheCoordinatorsforapproval.
e.ServeasSecretariattotheCommitteeandthesubgroupsofexperts
throughout the evaluation process, including preparation of the
hemisphericreportattheendofeachround.
f.Prepare, together with the Coordinator of the Committee and the
Coordinatorsofthesubgroups,thedraftfinalreporttobesubmitted
totheCommittee,pursuanttoArticle24.
g.PreparethedraftAnnualReportontheactivitiesoftheCommittee
and,oncesaidReportisadoptedbytheCommittee,forwardittothe
Conference.
h.ServeasacustodianforallthedocumentsandfilesoftheCommittee.
i.Disseminate, by electronic mail, the Internet, or any other means
ofcommunication,informationandpublicdocumentsrelatedtothe

j.Serveasthecentralcoordinatingandcontactpointforthedelivery
andexchangeofdocumentsandcommunicationsamongtheexperts,
asindividualsorasaCommittee,withtheConference,OASorgans,
andotherorganizationsorinstitutions.
k.NotifytheCommitteemembersofcommunicationsreceivedfortheir
consideration.
l.PreparetheminutesofCommitteemeetingsandmaintainitsfiles.
m.Provideadviceto theCommitteemembersontheperformanceof
theirresponsibilities,whenrequested.
n.Promote and organize technical cooperation programs in
conjunctionwithother internationalorganizationsandcooperation
agenciestosupportthe States Partiesintheireffortstoimplement
recommendationsoftheCommittee.
o.Preparethedraftformtobeusedforfollow-uponimplementationof
therecommendationstocountriesandpresentittotheCommittee
forapproval.
p.Any other responsibilities that the Committee may assign to it
or that pertain to the Secretariat for the effective fulfillment of its
responsibilities.
Article 8. Headquarters.
Pursuant to provision 7.1 of the Statute, the Committee shall have its
headquartersatthePermanentSecretariatoftheCIM.
TheCommitteemayholdmeetingsinaState Partyotherthanthe
countrywheretheheadquartersislocated,inaccordancewithArticle11.1
oftheStatute.

Article 9. Competent National Authority.
EachState Partyshallappointacompetentnationalauthoritytoliaisewith
theSecretariatoftheMESECVI.
Article 10. Observers.
Pursuanttoprovisions4.1and10.1oftheStatute,OASMemberStates
notpartytotheConventionmaybeinvitedtoobserveplenarymeetingsof
theCommitteeiftheysorequest.
Article 11. Special guests.
Experts may propose to the Committee, through the Coordinator, that
specialguestsparticipateinthemeetingsfortheexchangeofinformation,
experiences,andbestpractices.
Article 12. Financing. Voluntary contributions and solidarity subfund.
CommitteeactivitiesshallbefinancedinaccordancetoArticle11.1ofthe
Statute,whichestablishesaspecificfund.
IntheframeworkofArticle11.1oftheStatute,asolidaritysubfund
shallbesetuptoensuretheparticipationofexpertsfromcountriesthat,
owingtospecialcircumstances,areunabletofinancetheirparticipation.
SaidsolidaritysubfundwillbemanagedbytheSecretariatofMESECVI.
States and/or organizations making voluntary financial and
technicalcontributions,andcontributions inkind,shouldclearly indicate
what those fundsshouldbeused for.Also,additional resourceswill be
identified with the support of international cooperation agencies and/or
multilateralorganizations.
Article 13. Languages.
TheworkinglanguagesoftheCommitteearethelanguagesoftheStates
Parties,whicharealsotheofficiallanguagesoftheOAS.

Article 14. Quorum.
Quorumformeetingshallbeconstitutedbythepresenceofonehalfplus
oneoftheexpertsontheCommittee.2
Article 15. Decisions.
Asageneralrule,theCommitteeshalladoptitsdecisionsbyconsensus.
In those cases where there is a controversy with regard to a decision,
theCoordinatorshallusehisorhergoodofficesandallmeansathisor
herdisposaltotrytoreachaconsensus.Ifthispathhasbeenexhausted
andadecisionbyconsensusisnotpossible,theissueshallbeputtoa
vote. Decisions that concern the adoption of a country’s final report or
amendmentoftheseRulesshallbetakenwithavoteinfavoroftwothirds
oftheexpertspresentatthemeeting.3
Inallothercases,thedecisionshallbetakenbyhalfplusoneof
theexpertspresentat themeeting. In this lattercase,votesmaybe in
favor,against,orabstentions.
Noexpertmayparticipateinthevotingonthedraftreportofhisor
hercountry.
Article 16. Communications and distribution of documents.
Inordertoensuretheirpromptdistributionandreducetherespectivecosts,
all communications between the Secretariat and the experts and vice-
versa,aswellasdocumentstobeconsideredbythelatter,asindividuals,

2 The Inter-American Convention on the Prevention, Punishment, and Eradication of Violence against Women currently has 32 States Parties, so, for the Committee to meet, 16 of those states have to be present.3 Decisions on the adoption of the final report of a country or on amendments to these Rules of Procedure require the vote in favor of two thirds of the experts present at the meeting. Since there are currently 32 States Parties to the Convention, and assuming that the meeting has the minimum quorum required under the foregoing Article (16 experts), two-thirds is presently equivalent to 11 votes. Other decisions shall be taken by the vote of a simple majority of the experts present at the meeting.

iii. muLtiLatEraL EvaLuation ProCEdurE
Article 17. General aspects.
ReportsofallStates Partiesshallbeanalyzedsimultaneouslyinaninitial
multilateralevaluationround,whichmaybefollowedbyfurtherevaluation
rounds, the methodology and content for which shall be determined
subsequentlybytheCommittee.
Thedurationoftheroundsshallbetwoyears,withthethirdyear
being devoted to follow-up of the recommendations arising out of each
round.
Article 18. Questionnaire, Work Plan, and Evaluation Methodology.
The Committee Secretariat shall prepare the draft questionnaire, draft
work plan, and draft methodology for evaluating implementation of the
provisionsoftheConventionandshallforwardthemtotheexpertsofall
theStates Parties.
TheCommitteeshalladoptthefinalversionsofthequestionnaire,
workplan,andthemethodforevaluating.
TheSecretariatoftheCommitteeshallremitthequestionnairesto
thecompetentnationalauthorityresponsibleforcoordinatingthereplyof
each State Party andtothepermanentmissions.

Article 19. Replies of States Parties to the questionnaire.
The States Partiesshallforwardtheresponsestothequestionnairetothe
CommitteeSecretariatontheestablisheddate,viathepermanentmissions,
togetherwithanexecutivesummaryreportonthestatusofviolenceagainst
womenin therespectivecountry,andtheachievements,difficulties,and
areasinwhichtheyconsiderthatcooperationcouldbestrengthened.
Article 20. Subgroups to review information and prepare preliminary
reports.
The Committee, based on the proposal prepared by the Secretariat in
collaborationwiththeCoordinator,shalldeterminethecompositionofreview
subgroupsandassigntasksrandomly,bearinginmindthelegaltradition
ofthecountryreviewed,regionalrepresentation,languageconsiderations,
andtheequitabledistributionofworkamongalltheexperts.
Subgroupsshallpreparepreliminarycountryreportstobesubmitted
subsequentlytotheCommitteeplenaryforconsideration.
Noexpertmaytakepartinthepreparationofthepreliminaryreport
ofhisorherowncountry.
Article 21. Review of information and preparation of the preliminary
report.
Oncetheresponsestothequestionnairearereceived,theprocedureshall
beasfollows:
a.WiththesupportoftheSecretariat,eachexpertineachofthereview
subgroupswill,priortothemeetingoftheCommittee,receiveand
analyze the information provided by the States Parties assigned
tohisorhersubgroupandprepareadraftpreliminaryreportfora
countrythatwillbeassignedtohim/her,forsubsequentreviewby
thesubgroup.

b.Once the meetings of the review subgroups have concluded,
the draft preliminary reports will be discussed by the plenary in
accordance with Article 23 of these Rules. The Secretariat shall
sendthepreliminaryreporttothecompetentnationalauthorityand
to the corresponding Permanent Mission in order for the latter to
submit suchcommentsandclarificationsas it deemspertinent to
theSecretariatwithinthetimeperiodestablishedbytheCommittee.
Thisinformationshallbesenttotheexpertsofthereviewsubgroup
fordiscussionatitsnextmeeting.
c.BasedontheresponsesoftheState Partytothepreliminaryreport,
theexpertassignedtostudyitwillpreparearevisedversionofthe
preliminary reportand forward it to theexpertswhocomprise the
review subgroup, at least thirty (30) days in advance of the next
meetingoftheCommittee,whichwillconsideritinplenarysession.
Article 22. Length and format of country reports.
TheCommitteeshallconsiderandapprovethestructureofcountryreports
in accordance with the modalities approved for each round. All country
reportsshallhavethesamestructure.Theymustbeconciseandnomore
thantwenty(20)pagesinlength.
Article 23. Consideration and adoption of country reports.
For the consideration and adoption of country reports, the following
proceduresshallbefollowed:
a.Alloftheexpertsshallhaveaccesstothequestionnaireresponses
andcommentssubmittedbythe States Parties.
b.The review subgroups shall examine the revised version of the
corresponding preliminary reports and prepare the draft country
reports,whichtheassignedexpertshallsubmittotheplenaryofthe
Committeeforitsconsideration.

c.TheplenaryoftheCommitteemaymakeanychangesitconsiders
necessary to the draft country reports, which shall contain the
conclusionsandrecommendationsdeemedtobepertinent.
d.TheSecretariatshallcorrectthedraftcountryreportsinthemanner
agreeduponbytheCommitteeandpresentthemforapproval.
e.Once the country reports are approved, they shall be sent to the
competent national authority and the corresponding Permanent
Mission. The States Parties may submit additional observations
withinthetimeallowedbytheCommittee.
Article 24. Final report.
Uponconclusionofacompleteevaluationround,theCommitteeshalladopt
afinalreport,whichshallincludethecountryreportsandobservationsof
theStates Parties.Likewise,itshallincludeanoverallandcomprehensive
review (hemispheric report) that identifies strengthsandweaknesses in
implementationoftheConvention.
The hemispheric report shall contain, among other things, the
conclusionsandrecommendationsoftheCommitteebasedonthecountry
reports, to strengthen hemispheric cooperation in implementing the
Convention,especiallytheprovisionsconsideredinsaidround.
TheCoordinatoroftheCommitteeshallpresentthefinalreportto
theConference.Subsequentlyitshallbemadepublicandsubmittedtothe
AssemblyofDelegatesoftheCIMandtheOASGeneralAssembly.
iv. foLLoW-uP
Article 25. Follow-Up.
Followuponimplementationofrecommendationsshallbecarriedoutin
thecalendaryearfollowingapprovalofthecountryreports.

The MESECVI Secretariat shall send each State Party the
form approved by the Committee for follow-up on implementation of
recommendations tocountries inorder for them todescribeprogress in
implementationofsuchrecommendationsonthedatesetbytheCommittee,
inaccordancewiththeprovisionsofArticle7.ooftheseRules.
Therepliesofcountriesshallincludespecificmeasuresadoptedto
moveforwardintheimplementationofeachrecommendation.Countries
may indicate theirneeds for technicalorotherassistancerelated to the
implementationofrecommendations.
The Secretariat shall compile the replies in a preliminary
document,whichwillbeusedbytheCommitteetoprepareitsdraftreport
onimplementationofrecommendations,inaccordancewiththeprovisions
ofArticle7.ooftheseRules.
Thedraftreportonimplementationofrecommendationsshallbe
submitted to the Conference for approval and, following its publication,
shallbereferredtotheAssemblyofDelegatesoftheCIMandtheOAS
GeneralAssembly.
Article 26. Reports in the framework of plenary meetings of the
Committee.
AtthebeginningofeachCommitteemeetingeachoftheStates Partiesmay
present, inwriting, informationonthemeasuresithasadoptedbetween
thepreviousmeetingand thepresentoneaimedatmakingprogress in
implementingtheConvention.TheSecretariatshallalways.
v. PartiCiPation of CiviL soCiEty organizations
Article 27. Participation of civil society organizations.

The Secretariat shall forward the information that complies with
thetermsandconditionsreferredtointhisArticlebothtothe State
Party underanalysisandtotheexpertsinthecorrespondingreview

Article 28. Distribution of information and proposals put forward by
civil society organizations.
Theinformationandproposalspresentedbycivilsocietyorganizations,in
accordancewiththeprovisionsintheforegoingarticle,shallbedistributed
inthelanguageinwhichtheywerepresented.

The information and proposals presented by civil society organizations
thatarenotinelectronicformatshallonlybedistributedattheCommittee
meeting when they are no more than ten (10) pages long. If they are
longer,civilsocietyorganizationsshallprovidetheSecretariatwithcopies
fordistribution.
Article 29. Participation of civil society organizations in Committee
meetings.
The Committee may accept requests from civil society organizations to
giveaverbalpresentation,priortothestartoftheformalmeetingofthe
Committee,ofanyinformationandproposalstheyhavesubmittedpursuant
to Article 28 of these Rules. The Committee shall decide how long the
verbalpresentationmaylast.
